Engelberto Rubio Jr., hired three months ago, was in the midst of an 18-month probationary period when police officials learned earlier this month of the allegations against him in Colusa County, where Rubio lives... Rubio surrendered to Colusa authorities on Oct. 22 and faces a felony charge of corporal injury to a child and a misdemeanor charge of child endangerment. Ashley Nicole Rubio, the officer's wife and the child's stepmother, faces a count of child abuse/endangerment... Suisun City Police officer Engleberto Rubio Jr. is accused of abusing his five-year-old son. The boy's step mom, Ashley Rubio is also facing charges. Investigators say the abuse took place in the pair's College City home. Detectives say police got involved when the boy's mother, a Colusa County Sheriff's Department employee, noticed the bruises. "When he [boy] came home after visitation he had numerous bruises that were great concern," said John Poyner, Colusa County District Attorney. The Suisun Police Department has placed Rubio on unpaid leave for a month. Scott Corey, a police spokesman says, "We do particularly hold that standard for police officers, they should be respecting the laws they are enforcing." On Oct. 16, Suisun City Police Officer Engelberto Rubio Jr. began a 30-day unpaid administrative leave after the Suisun City Police Department learned of impending child abuse charges in Colusa County, his county of residence. Rubio surrendered to authorities on Oct. 22 in Colusa County on allegations of felony infliction of corporal injury upon a child and misdemeanor child endangerment charges. "This is a very difficult situation for the Suisun City Police Department, as it is with any employer," said Public Information Officer Scott Corey. "We can't control what happens to our employees during their off-duty hours. Obviously, we expect them to conduct their affairs in a lawful and ethical manner." Rubio was hired approximately three months ago and was in the midst of an 18-month probationary assignment standard for all newly hired Police Department employees. When the Colusa County District Attorney's Office contacted the Suisun City Police Department earlier this month to notify officials regarding the allegations, Rubio was removed from street patrols and assigned to administrative duties. On Oct. 16, the Colusa County District Attorney Office indicated there was sufficient evidence to bring charges. Rubio began an unpaid leave to provide time to resolve the matter. If the charges are not resolved during his leave, Rubio may either resign or be terminated from his Suisun City employment. [LINK]

[Excerpts] ...The District Attorney's Office conducted the investigation because the alleged victim's biological mother is an employee of the Colusa County Sheriff's Office, said District Attorney John Poyner. "They didn't feel it would be appropriate, so we agreed to handle it," Poyner said... The alleged victim is staying with his mother and reportedly is in good condition, Poyner said. Rubio became a Suisun City police officer less than three months ago, said Commander Tom Mattos of the Suisun City Police Department. Mattos said Rubio is on a 30-day unpaid leave of absence effective last Friday, two days after the charges were filed. Rubio requested the leave of absence for personal reasons, Mattos said.   2. Are you implying that all the police are so stupid that the ex-wife could orchestrate this charge by beating her child and getting the child to lie for her? I don't understand what your point is other than that this charge surprises you.

    MAYbe his ex had reason to have conflicts with his parenting if he is so rigid that he would do this to a small child.

  3. I know a side of him that many of you probably dont I can tell you that he is capable of this. I dont know his ex-wife well, but I do know that NO mother wants to see their child go through this. I do know John Poyner the DA very well and if there wasnt sufficient evidence, he would not have brought charges. Just because "The Rubio's" are great people, doesnt mean that they dont make mistakes or bad choices, as we all know he did while he worked in Yolo County. There is a reason he is no longer employed there. Does drugs ring a bell?

  5. Well apparently there wasn't enought evidence and all this was a case of a vindictive ex-wife. He was found NOT GUILTY, just in case you guys were wondering. And the wife lied while testifing.Ignorant people are those who choose to jump to conclusions before knowing the facts. Hey why aren't the news on news papers covering the outcome. Hmm makes you think.

  6. So despite all we know about how things work, you want people to assume that if a cop gets away with it (charges are dropped, he's cleared, "insufficient evidence", victim is afraid or intimidated into not cooperating or dropping the charges) that the officer is then INNOCENT - right?
    I tell you what, it's amazing what a lying & vindictive sample of womanhood officer's wives are if you believe the cops that write in the comments to these posts. Officers on this blog all have violent lying wives with mental health problems who are unfaithful and trying to ruin the officer's career. I wonder why officers marry those kind of women. Don't YOU?

  8. I think there should be an update on this case since both Engelberto and Ashley were found not guilty. There should also be a report done on the corruption inside the Colusa Sheriff's Department. The ex-wife is always trying to hurt both Engelberto and Ashley on any personal level she can.What is a shame is that she and other officers falsified reports. Shame on them for dragging this poor little boy through all the trauma this must have caused him. I hope he is able to see his dad again soon.

    As to those of you who think that the ex wife would never lie or convince her son to do so, maybe you should think twice before you comment since you probably don't know anyone connected to the case. And how do you know she didn't spank him to accuse her ex husband? And what about the Officers who lied? Knowing both sides of this story personally and knowing all involved, I had no doubt that Engelberto and Ashley would be found INNOCENT! No wife would stand beside a husband accused of child abuse while having other children at home around the accused. I hope that they are able to continue with their lives and that this horrible accusation won't follow them around.

    Again, shame on the ex wife.

  9. For all you ignorant people out there who decided to throw allegations out there against the couple. Goes to show what kind of society we live in today always in a rush. Get your freakin facts straight, the couple was acquitted by a jury of 12 and all the evidence was there. Not only that Naborina lied under oath, also as a mandated reporter she supposely suspected her son was being abused, but still let him go over and visit for a length of time before this incident. As far as the DA, that's another story, they were discredited on the way they handled the investigation including coflict of interest. That's not all the history of Naborina using the Colusa Sherriff's department at her own convenience as her bodyguards and harassing the Rubio's whether it be at the place of business or residence. I'm glad the dirt on her is finally out and people could understand the turmoil the couple went through.

  11. The ex-wife cooked this up. She's a Sheriffs employee who knows how to work the system, and knows there is no penalty for lying. She also knows folks at the agency where the report was made.

  12. Couple acquitted of child abuse

    A Colusa jury has acquitted a College City couple of child abuse charges.

    Engelberto Rubio and his wife, Ashley, were each charged in October charged with one misdemeanor count of child endangerment. Engelberto Rubio, a 32-year-old former police officer, was also charged with one felony count of inflicting corporal injury against his 7-year-old son.

    The jury handed down the “not guilty” verdict Friday in Colusa County Superior Court.

    The Colusa County district attorney’s office conducted the investigation because the child’s mother, Naborino Rubio, is employed at the Colusa sheriff’s office.

    Colusa DA John Poyner said he was “absolutely fine” with the verdict.

    “That’s the system,” he said. “We put our evidence out there and the jury makes their decision. We don’t take it personal.”

    Ashley Rubio said she was glad the trial was over, but called it “a complete waste of our time.”

    Engelberto Rubio declined to comment.

    “All we want is for people to know that our names have been cleared,” Ashley Rubio said.

    She said the defense argued that the child might suffer from lupus, a hereditary condition that manifests in a variety of conditions, including a predisposition to bruising.

    “What occurred between my husband and stepson was just a father disciplining his son, not child abuse,” she said.

    Engelberto Rubio requested administrative leave from the Suisun City Police Department two days after the charges were filed in October. He resigned in November for “personal reasons” after just three months on the job, a department spokesman said in a previous interview.

    A phone call to Suisun City police Cmdr. Tim Mattos was not immediately returned.
