HARLEM - An off-duty New York City police officer is under arrest and charged with shooting a woman she lives with. When police arrived at the apartment on West 128th Street in Harlem Monday, they found the two women fighting. Police say one of the women, identified as officer Ekeythia Dunston, shot the other woman in the leg and shoulder. The victim is in serious condition. Dunston has been suspended without pay. [LINK]

[Excerpts] MANHATTAN — An off-duty police officer shot her girlfriend early on Monday after a suspicious text message sparked a violent argument in their Harlem home, police said. Sources told the Daily News that the fight started when police officer Ekeythia Dunston, 32, got a text message from another woman at about 3.25 a.m., enraging her partner Erica LeGall, 42. LeGall hit Dunston across the head with a clothes iron, leaving a "tennis ball sized welt," the News reported. Dunston, picked up her pistol, and shot LeGall once in the thigh and once in the shoulder, police said. The two argued as LeGall's son [J.], 7, and Dunston's son [D.], 13, slept in their room. The couple's 32-year-old baby sitter was also in the apartment, but was not harmed, police said... [Excerpts] MANHATTAN CRIMINAL COURT — An off-duty police officer charged with shooting her domestic partner during a dispute over a text message was "justified" when she opened fire, her lawyer said Tuesday. Edgar De Leon, attorney for Ekeythia Dunston, 32, who is assigned to the 108th Precinct in Queens, said his client was defending herself from her girlfriend, Erica LeGall, 42, who hit her with an iron. "She was going to get her head cracked open," said De Leon. "This was a justified shooting. She was severely assaulted with an iron."... [Excerpts] ... Ekeythia Dunston, who joined the NYPD eight years ago, was arraigned on assault charges Tuesday morning and released after she made $1,000 bail... Investigators believe LeGall got the upper hand, snatched a clothes iron and bashed Dunston with it several times on the head, according to prosecutors. Dunston managed to free herself and grab her service revolver - and then fired a pair of shots... "Dunston was severely beaten with the iron," said her defense lawyer, Edgar De Leon. "Her head was almost split open... It was a domestic dispute that escalated and she had to defend herself... I think it is safe to say this relationship is over." De Leon claimed the low bail - and the lack of an attempted murder charge - shows that prosecutors believe Dunston's claim of self-defense... LeGall, who is in stable condition at Harlem Hospital, will also be charged, according to prosecutors. Her arraignment is expected later this week... A messy domestic battle in which a city cop admittedly shot her girlfriend with her service revolver in Harlem got messier yesterday when the girlfriend was charged with starting the fight -- by swinging a clothing iron.
Erica Legall, 42, was charged with felony assault for allegedly striking her gal pal, Ekeythia Dunston, 32, in the head with the iron as they sparred over the contents of a text message in Legall's apartment last week.
Dunston is the niece of former Met and Brooklyn sandlot legend Shawon Dunston.
Legall, who'd been hospitalized for bullet wounds to the shoulder and leg, was freed without bail.

Ekeythia Dunston was charged last week with the highest level of felony assault -- a charge carrying a maximum sentence of up to 25 years in prison -- and is free on $1,000 bail.
The two signed orders of protection against each other.
