OSBORN
Published: Oct 28 2008,

As one chapter in former Blue Lake Police Chief David Gundersen’s run through the legal system ends, another is gaining momentum.

Although Gundersen still faces allegations of forcible rape and illegally accessing a person’s information when it comes to “Jane Doe No. 2,” an investigation by the Trinidad Police Department, where Gundersen worked as police chief from Aug. 1, 1997, to Nov. 29, 1999, alleges firearm violations against him. The alleged incidents involving Doe 2 occurred in March 1999.

Humboldt County District Attorney Paul Gallegos said he heard something about the investigation a while ago, but nothing came of it.

He said he wouldn’t go into details about the investigation, about which he was recently briefed — only that it involved alleged firearm violations dating back to when Gundersen ran TPD.

The District Attorney’s Office has yet to receive that report.

When contacted, TPD Police Chief Ken Thrailkill would only confirm that an investigation is under way and wouldn’t provide any other details into the investigation.

Gundersen’s attorney, Russell Clanton, couldn’t be reached for comment by deadline.

A jury of seven women and five men acquitted Gundersen on Sept. 24 of the 24 counts of spousal rape against him, instead finding him guilty of 11 counts of battery — a lesser crime. The jury also found him guilty of illegally possessing a machine gun and a silencer and violating a court order.

After posting bail and missing his first sentencing date, Humboldt County Superior Court Judge W. Bruce Watson placed Gundersen back into custody and raised his bail from $50,000 to $200,000 on Friday.

Later that day, he posted the $200,000 bail.

Gundersen faces a maximum of three years, eight months in prison. His sentencing was continued until Nov. 21.

(John C.
