[EXCERPTS] Floyd County, In. - Former Indiana State Trooper David Camm will be tried a third time for the murders of his wife and children. Floyd County Prosecutors say "it's worth it" to try David Camm for a third time. Camm was convicted twice in the killings of his wife, Kim, and their two children, Brad and Jill, who were found shot to death at their southern Indiana home in September 2000. The first Camm conviction was overturned because the prosecutor included Camm's extramarital affairs in the evidence. The second conviction was thrown out after allegations surfaced that Camm committed the murders to cover up molesting his daughter... Janice Renn, Kim Camm's mother said she wants "justice". "It's hard. This was my daughter and my grandkids and every day I have to live with this...I just want justice for them, because in my heart I really believe that David is guilty," said Renn. David Camm's Uncle, Sam Lockhart said, "We're ready. We'll be ready as a defense team and as far as a family, we're ready to do it." [LINK]

    OPINION

    BAKER, Judge.

    Appellant-defendant David R. Camm appeals the trial court's denial of his petition for the appointment of a special prosecutor pursuant to Indiana Code Section 33-39-1-6-(b)(2). More particularly, Camm argues that the trial court erred when it found that the prosecutor's now cancelled literary contract did not constitute clear and convincing evidence of an actual conflict of interest. Camm further contends that the trial court erred when it required that he show harm in order to prove an actual conflict of interest. Concluding that prosecutor's literary contract created an irreversible, actual conflict of interest with his duty to the people of the state of Indiana, we find that the trial court erred when it denied Camm's petition. Thus, we reverse and remand for the appointment of special prosecutor and for further proceedings consistent with this opinion...

    INDIANAPOLIS - The Indiana Court of Appeals has ordered the appointment of a special prosecutor for the third trial of an ex-state trooper accused of killing his family, saying the current prosecutor's intention to write a book about the case created an "irreversible" conflict of interest. In its ruling Tuesday, the three-judge panel ruled Floyd County Prosecutor Keith Henderson's book deal had made him an issue at David Camm's trial, even though the deal has since been dropped. Camm remains in prison. He's accused of fatally shooting Kimberly Camm and their children - 5-year-old Jill and 7-year-old Bradley - at the family's home near Georgetown in 2000, about four months after he resigned from the state police. Juries have twice convicted Camm on murder charges that were reversed on appeal.
