[Excerpts] SPRINGFIELD - Drug suspects continue to be spared years behind bars, thanks to relentless credibility questions about a veteran Holyoke narcotics detective under investigation for alleged evidence tampering. Growing numbers of drug prosecutions have been dismissed by judges or abandoned by prosecutors as detective Paul C. Barkyoumb has virtually disappeared in the wake of accusations by his ex-girlfriend that he sent her threatening text messages with a suspect’s cell phone he is claimed to have pocketed during a drug raid and failed to have turned in as evidence. Officials say Barkyoumb is on paid administrative leave pending the outcome of an internal Holyoke Police Department investigation. He also is the subject of a criminal probe by the Connecticut State Police, where Barkyoumb’s ex-girlfriend, Michelle Cruz, works as the state’s top victim advocate. Holyoke Police Chief Anthony R. Scott has refused comment. A spokesman for the Connecticut State Police said their investigation is ongoing... Hampden Superior Court Judge Peter A. Velis recently labeled a string of collapsed cases a product of “the saga of officer Barkyoumb.” Velis made the quip in a court session on Tuesday when he signaled his inclination to dismiss a case against Ramon Pineda, of 775 High St., Holyoke. Pineda is charged with cocaine trafficking and faces 15 years in prison. He was arrested on May 8 with an estimated $120,000 in cocaine and heroin, according to police reports, and has pleaded innocent. The fate of Pineda’s case is similar to at least a half-dozen other pending cases in which Barkyoumb was the lead investigator. The detective has failed to testify in several pretrial hearings, forcing two scenarios: either the judge dismisses the case or prosecutors have to throw up their hands without their linchpin witness. Prosecutors previously said Barkyoumb was scheduled to return this month, but that has been pushed off indefinitely. “I’m looking at the global picture,” Velis told lawyers during a pretrial hearing in Pineda’s case. “It’s time that everyone stop kidding themselves about his availability”... In addition to those recent dismissals, cocaine and heroin trafficking charges against four defendants on Nov. 24 were dropped because of Barkyoumb’s absence...     [Excerpts] A troubled former Holyoke police officer is being held on $750,000 bail after pleading not guilty to a charge of cocaine trafficking near a drug-free school zone. Forty-year-old Paul Barkyoumb was arraigned in Springfield District Court on Monday on charges including trafficking between 28 and 100 grams of cocaine within 1,000 feet of a school zone. He was also accused of participating in the sale of about 55 grams of cocaine to a person who was cooperating with the police Thursday. Hampden District Attorney Mark Mastroianni says Barkyoumb was paid $2,400 in marked police bills... [Full article here]

  2. PAUL BARKYOUMB RESIGNS AS HOLYOKE POLICE OFFICER AS PART OF HARASSMENT SENTENCING RECOMMENDATION

    [Excerpts] Holyoke police officer Paul C. Barkyoumb has resigned, a condition of a sentence recommendation involving criminal harassment of a former girlfriend that was agreed to Monday by Westfield District Court Judge Philip A. Contant... “I am resigning from the Police Department based on the fact that I was treated unfairly and given an unfair investigation by the Holyoke Police Department. I feel I was bullied into this decision by YOU, Chief Anthony Scott.” Scott said "there is nothing bully about this. He (Barkyoumb) pled guilty and that (residnation) was part of the deal. And, in reference to not supporting him, I backed Barkyoumb against Superior Court Judge (Cornelius J.) Moriarty. I am trying to maintain a department with credibility and will continue to do so"... [Hampden County Assistant District Attorney Howard] Safford said “We worked long and hard to satisfy the issues of the victim. We arrived at a settlement that is appropriate and protects the victim in the future.” As part of the court agreement, a larceny of under $250 involving a cell phone was continued for a not guilty finding and will be dismissed after two years probation. A third charge of perjury was not prosecuted. Barkyoumb was charged with sending threatening messages to Cruz, a former Hampden County prosecutor and a top victim advocate in Connecticut from April - July 8, 2009... [Full article here]
