MyFox ...Fired Peoria Sergeant to Appeal Termination<br />MyFox Phoenix<br />Updated: Friday, 26 Mar 2010, 4:40 PM MDT<br />Published : Friday, 26 Mar 2010, 4:40 PM MDT<br /><br />PEORIA - A Peoria Police officer who was fired for allegedly threatening his wife is now fighting to get his job back.<br /><br />Police say 51-year-old Tim Smith was fired after he threatened to kill his wife and sent her threatening text messages.<br /><br />Sgt. Smith is accused of telling his wife over a city-issued phone in December, "If you come in here with the cops, you'll be the first one to die," his wife told police.<br /><br />According to an internal investigations report, Smith told investigators he was too drunk to remember what he said or texted to his wife.<br /><br />The report also mentioned an incident in which Smith placed a GPS tracking device on his wife's car without her knowledge or the department's permission.
