TUALATIN, Ore. - The Washington County District Attorney says no charges will be filed against 24-year-old Ryan Osbrink, who accidentally shot his wife last December. Osbrink called 911 on the night of Dec. 16 requesting immediate medical attention for his 23-year-old wife, Kimberly. The newly-hired Clark County officer told police he had accidentally shot her while practicing a maneuver. Police arrived and found Kimberly suffering from gunshot wound to the abdomen. She told police, "It was an accident…he didn't mean to do it." Kimberly was transported to Oregon Health and Science University where she died in the early hours of Dec. 17. Investigators say Ryan Osbrink has cooperated with the months-long investigation and that his account of what happened on the night of his wife's death never varied. [Source]

It has been four long months for Ryan Michael Osbrink of Tualatin, the decorated Marine sergeant who unintentionally shot and killed his wife in December. While under investigation, Osbrink turned over his handgun to police, declaring he never wanted to see it again. He abandoned plans for a law enforcement career and began working as a truck driver, hoping he could forge a new life amid the questions, criticisms and pressure aimed at him. But on Friday, one question about his future finally became clear: Washington County authorities announced that Osbrink will not face criminal charges. Osbrink, 24, was at home on the evening of Dec. 16, practicing drawing his .45-caliber semiautomatic pistol from its holster, when the gun went off, firing a bullet into his wife's abdomen, police said. Osbrink called police to report the shooting. When officers arrived, he was trying to revive his 23-year-old wife, Kimberly Lynn.     Dear Chief Barker:

    On Sunday, December 16, 2007 at 10:25 p.m. Tualatin Police officers were dispatched to 6935 SW Nyberg Road, Apt. # R203, The 911 caller, Ryan Osbrink, requested immediate medical attention for his wife Kimberly, stating he had accidentally shot her. Dispatch remained on the line with Ryan until police arrived. .

    Police found Kimberly with a gunshot wound to her abdomen. Kimberly was conscious but in great pain. Officer Quinn Black asked Kimberly what had happened. Kimberly responded, "He was practicing, it was an accident." As emergency medical was arriving, two other officers on scene heard Kimberly say, "It was an accident... he didn't mean to do it."

    Kimberly was transported to OHSU where she died at 1:50 a.m. on December 17, 2008. The Oregon State Medical Examiner's Office conducted an autopsy on December 17 and determined the cause of death to be a single gunshot wound to the abdomen.

    Tualatin Police Detective Kevin Winfield led the investigation into Kimberly's death. He was assisted by other Tualatin Police officers, as well as Washington County Major Crimes Team detectives from the Forest Grove Police Department and the Washington County Sheriffs Office.

    Ryan Osbrink cooperated completely with the investigators. He provided investigators with repeated access to the scene of the shooting. He provided investigator's with a 'walk-through' of the shooting. He was interviewed/ interrogated extensively. His accounting of what occurred never varied. He provided releases for military, medical and employment records for

    background investigation. Investigators spoke with employers, friends, relatives and the parents of both Ryan and Kimberly.

    In the end, the investigation revealed no evidence that Ryan intended to injure or cause the death of Kimberly. Both the physical evidence at the scene, and the wound to Kimberly, is consistent with the account given by Ryan. The investigation reveals a happily married young couple with good friends and close, supportive families on both sides.

    I have reviewed the investigation in its entirety. I visited the scene of the shooting with investigators. I have reviewed the Medical Examiner's report as well as Kimberly's OHSU records.

    Most importantly, I have met personally with Kimberly's mother and father. I was quite impressed. They are both remarkable people. Ryan is apart of their family. They continue to maintain a close relationship with Ryan and are doing all they can to help Ryan in reconstructing his life. They think the world of Ryan and would be unhappy and upset to see criminal charges brought against Ryan in the tragic death of Kimberly.

    The State will not pursue criminal charges in this matter.

    There are valid arguments on either side of the issue of bringing negligent homicide or even manslaughter charges in cases involving the unintentional death of loved ones as a result of unsafe practices with handguns. That larger debate will always factor into the decision to pursue, or not to pursue, criminal charges in a particular circumstance. In this case, the decision is clear that the community as a whole would receive no benefit in a criminal prosecution. I not only respect the wishes of Kimberly's parents, but I also agree with their conclusion.

    This letter concludes our review of Kimberly's death.
