EX-OMAHA POLICE OFFICER SENTENCED FOR HURTING WIFE
The Associated Press
August 31, 2010
A former Omaha police officer will spend 30 days in jail and spend two years on probation for choking his wife last December. Douglas County District Judge Greg Schatz sentenced 41-year-old Sean Heyenga Tuesday for two counts of misdemeanor assault. Prosecutors said Heyenga came home after drinking and got into an argument with his wife. They say he tried to strangle her, caused her to pass out and threatened to kill her. The original felony charges against Heyenga were reduced after his wife changed her story about what happened during the attack and said she was the aggressor. Schatz also ordered Heyenga to take anger management classes and get treatment for alcohol abuse. [LINK]

EX-COP GETS JAIL FOR WIFE ABUSE

In a "frustrating" turn of events, prosecutors say, they were unable to secure felony convictions against an Omaha police officer accused of a vicious assault on his wife. Tuesday, a judge gave the officer 30 days in jail for two counts of misdemeanor assault... followed by two years of probation. [Douglas County District Judge Greg] Schatz said he was convinced that Heyenga’s wife initially told the truth to police about a December 2009 assault... Three weeks later, she changed her story... Schatz didn’t buy it. But in putting Heyenga on probation, the judge noted that Heyenga had no record. And the wife has remained with Heyenga. "She obviously is in denial," Schatz said. "She wants to stay with the defendant. I think what would be best for her to stay with him is to place him on probation and get him help for his anger management." Schatz ordered that Heyenga complete anger management counseling and treatment for alcohol abuse as part of his probation. Heyenga originally was charged with two felonies punishable by up to 10 years in prison. "I can assure you, if you violate this probation, I’m going to resentence you to jail on both of those counts," Schatz said. "I would hope for your sake as well as (the wife’s) that you get some help for whatever problems you have." [LINK]

2 VICTIMS CHANGE THEIR STORIES
World-Herald
By Todd Cooper
June 15, 2010
[Excerpts] ...The victim in the Heyenga case initially told police and court officials that her husband, Sean, then an Omaha police officer, had threatened to kill her and had choked her so hard and so long that she lost consciousness and urinated on herself. “I was afraid that I was going to die,” she wrote in a court affidavit. “I remember him choking me harder and harder and (I) was unable to speak. I was going in and out of consciousness.” Three weeks later, she changed her story. She said that she was the aggressor and that “Sean never threatened me and I never lost consciousness.” “I am in no danger from Sean nor have I ever been,” she wrote. She has been steadfast in that second story ever since. The result? Originally charged with strangulation and terroristic threats - felonies punishable by up to 10 years in prison — Heyenga pleaded no contest Monday to two misdemeanor assault charges in connection with the Dec. 17 attack at his home... prosecutors say they tried to work around the victims' changed stories... [GA] Lynn Turner, who killed her police officer husband and firefighter ex-deputy boyfriend, found dead in cell

Forsyth County Firefighter, Ex-Deputy Randy Thompson

Cobb County Police Officer Maurice Glenn Turner

...[Julia Lynn Womack Turner] was convicted of the 1995 murder of her 31-year-old husband, Cobb County police officer Glenn Turner. She also was convicted of murdering her Forsyth County firefighter boyfriend and the father of her daughter, 32-year-old Randy Thompson, six years later... Both men were law enforcement officers when they became involved with Lynn Turner... Lynn Turner, painted by prosecutors as a classic black widow who lured two law enforcement officers into her life, then killed them for their money by poisoning them with antifreeze... The men didn't know each other and their deaths were not linked initially despite some similarities. Both suffered flu-like symptoms before they were discovered home alone, dead. Both were believed to have died of cardiac dysrhythmia, or an irregular heartbeat... Kathy Turner, the woman's mother-in-law, told The Atlanta Journal-Constitution. “It comes around, doesn’t it?"... Kathy Turner didn't want to hear that Lynn Turner was still trying to defend herself, and got her wish. "I’m glad I will never have to see her in court again," the former mother-in-law said...

LYNN TURNER'S DEATH STILL LEAVES QUESTIONS, SCARS
The Atlanta Journal-Constitution
By Marcus K. Garner and Dan Raley
Tuesday, August 30, 2010
[Excerpts] Lynn Turner’s victims died mysteriously, without warning or ready cause. On Monday, the same thing happened to the two-time convicted killer. Turner, 42, was found unresponsive in her cell at Metro State Prison just before 7 a.m. and declared dead 40 minutes later. An autopsy later in the day couldn't determine what killed her... The former 911 operator was serving life sentences for the fatal antifreeze poisonings of Glenn Turner, her husband, in 1995 and Randy Thompson, her boyfriend and the father of her two children... “I think she just didn't have anything to live for," Kathy Turner, the woman's mother-in-law, told The Atlanta Journal-Constitution. “It comes around, doesn’t it?" Juries had determined that Turner, described by those who knew her as attractive and personable, had killed a Cobb County police officer and a Forsyth County firefighter for nothing more than money, for their life insurance policies and pensions totaling $200,000, miscalculating she would receive double that... Convictions three years apart came next for Turner, the last one in 2007. Again, money was the motivation. Witnesses from Turner's first trial testified that she had collected more than $140,000 in insurance benefits and $700 per month from her husband's police pension after he died. In the second trial, evidence was presented that Turner had received $36,000 from an insurance payout and had hoped to cash in on another policy worth $200,000 that named her as the beneficiary, but it had lapsed... Kathy Turner didn't want to hear that Lynn Turner still trying to defend herself, and got her wish. "I’m glad I will never have to see her in court again," the former mother-in-law said. "There’s never really any closure," said Brandie McNeal, Thompson's sister. "My brother’s gone"... [Full article here]

[Excerpts] ...The family of one of her victims, former Cobb County police officer Glenn Turner, said they have forgiven Lynn for what she did to Glenn. But they don't feel like justice has been served by her losing her life. "No I don't," said Glenn Turner's mother Kathy Turner. "But I'm happy I don't have to see her anymore in the news or in court or anywhere." Asked if her death was some form of justice, James Turner said no, it wasn't. "Justice was her being there (in prison), living with this," said James Turner... Lynn Turner was found dead in her cell at Metro State Prison in DeKalb County. There were no signs of trauma to her body... [Full article here]

TOXICOLOGY RESULTS WILL DETERMINE LYNN TURNER'S CAUSE OF DEATH
The Atlanta Journal-Constitution
By Rhonda Cook and Marcus K. Garner
Tuesday, August 31, 2010
[Excerpts] Blood test results are needed before the Georgia Bureau of Investigation can say what killed Lynn Turner, convicted of using antifreeze to murder her husband and boyfriend, officials said Tuesday. "Hopefully we'll have the results back in a few weeks or sooner," said GBI spokesman John Bankhead. The test is being rushed, he said... Turner was convicted of the 1995 murder of her 31-year-old husband, Cobb County police officer Glenn Turner. She also was convicted of murdering her Forsyth County firefighter boyfriend and the father of her daughter, 32-year-old Randy Thompson, six years later. The men didn't know each other and their deaths were not linked initially despite some similarities. Both suffered flu-like symptoms before they were discovered home alone, dead. Both were believed to have died of cardiac dysrhythmia, or an irregular heartbeat But Lynn Turner had moved in with Thompson four days after her husband's death and they had a daughter 10 months after Glenn Turner died. And once their Lynn Turner connection was realized, Glenn Turner's body was exhumed and tissues from both men were retested. Both had died from poisoning by ethylene glycol, the sweet, odorless chemical in antifreeze... "I don't think it’s unreasonable to think there might have been a third victim," [Forsyth County District Attorney Penny] Penn said... [Full article here]

COP'S WIDOW 'DISTRESSED' BY SPOTLIGHT
The Atlanta Journal
Jane O. Hansen
Aug 11, 2001
[Excerpts] In her first public meeting with a horde of reporters and cameramen Friday, Lynn Turner said nothing. Instead, the Forsyth County woman who is a key figure in a reopened investigation into three deaths stood at her attorney's side, her mouth closed, her eyes mostly cast downward... Police recently have renewed investigations into the January death of Randy Thompson, 32, a former Forsyth sheriff's deputy, and the 1995 death of 31-year-old Maurice Glenn Turner, a Cobb County police officer. Lynn Turner, 33, is Glenn's widow and the mother of Thompson's children. Both men's deaths were sudden and similar. The GBI also is looking into the 1999 death of Lynn Turner's former boss, Maj. Ronald Casper of the Forsyth County Sheriff's Office... "Ms. Turner is naturally distressed by the degree of speculation and conjecture which has surrounded this case," [her attorney, Rafe Banks] said... She also recently lost her job with a Forsyth County judge "because of this," Banks said... Police reports show [Randy] Thompson took an overdose of pain pills and sleeping pills in February 1997... Thompson also pleaded guilty to simple battery against Lynn Turner involving a November 1997 incident of domestic violence... he hit her with his arm and fist, bloodying her lip, the sheriff's report says. She was pregnant at the time. Thompson was sentenced to 10 months' probation and ordered to stay away from Lynn Turner... It was not the first violent incident involving the two. In September 1996 she went to the emergency room with a dislocated shoulder and bruised ribs after telling authorities he'd pushed her to the floor following a day of drinking. The incident was never prosecuted. Thompson's parents said Friday they were upset by the statements about their son. "Randy had his problems just like everybody," said Randy's father, Perry Thompson. "But he was not the emotionally troubled person like I felt they were trying to portray him to be. Somebody, whoever it is, is trying to discredit Randy."

CRITICAL HEARING WITNESSES DESCRIBE WOMAN IN ANTIFREEZE POISONING CASE
The Atlanta Journal
JANE O. HANSEN
Jul 8, 2003
[Excerpts] The woman charged with killing her husband by poisoning him with antifreeze expressed little sorrow when he died, a close friend of the Cobb County police officer testified Monday. Donald Cawthon, who described himself as Officer Maurice Glenn Turner's best friend, cast defendant Lynn Turner as a cold, controlling woman. Cawthon said Lynn Turner shed no tears at the funeral home and her behavior seemed inconsistent with a woman who had just lost her husband. He said he overheard her complaining loudly about plans for the pomp and circumstance of an official police funeral... Although Lynn Turner is not yet on trial, prosecutors will argue this week that Glenn Turner's death was so similar to the death six years later of a Forsyth County firefighter that the jury should hear the details of both in her upcoming trial... In 2001, [Cobb Medical Examiner Brian] Frist conducted a second autopsy after Turner's body was exhumed and concluded Turner had died of poisoning... Witnesses' testimony showed both men suffered from nausea, vomiting, diarrhea, headache and hallucinations before seeking medical help at local emergency rooms.

TURNER FACES SECOND TRIAL IN POISONING
The Atlanta Journal-Constitution
By Jane O. Hansen
Published on: 01/07/07
[Excerpts] Donald Cawthon remembers the first time he saw her. It was 1990, and she was with a group of cops in an apartment somewhere in Cobb County. They were planning to go clubbing in Buckhead. The lights were out in the living room. It was so dark that Cawthon joked to the officer who lived there: Did you forget to pay your light bill? Then she emerged from the shadows — a shapely female in a tight blue dress, with long brown hair, coming toward him down a hallway. She was brandishing two pistols. Oh, is she a police officer, too? Cawthon asked Lynn Turner wasn't a police officer. But she sure liked to be around them... Both men were law enforcement officers when they became involved with Lynn Turner. Both died in their early 30s after first becoming so violently ill that they sought help at a local hospital. Both later told family members they felt better before they were found dead, home alone. Both were dressed in undershorts and covered with blankets. Even their deaths were initially attributed to the same natural cause: cardiac dysrythmia, or an irregular heartbeat. It wasn't until Thompson died — nearly six years after Glenn Turner — that authorities learned that the two men shared a common bond: Lynn Turner. Following each of their deaths, she collected thousands in insurance and pension benefits. In the summer of 2001, Turner's body was exhumed from his Marietta grave, and his tissues and those of Thompson's were retested. Both men were found to have died from ethylene glycol, the colorless, odorless, sweet-tasting chemical that makes up antifreeze... She may have been sleeping with Thompson while still married to Glenn Turner, but that doesn't make her a murderer, her lawyers argued... Throughout it all, Turner has so far said nothing in her own defense... She seemed confident she wouldn't be spending the rest of her life in prison. It's not "if" she gets out, she corrected a reporter in 2004, just hours before she was convicted and sentenced to life. "It's when." [Full article here]

TURNER GUILTY, MAY FACE DEATH: Sentencing phase of trial to begin Monday
Gainesville Times, GA
By STEPHEN GURR
March 25th, 2007
[Excerpts] Randy Thompson can rest in peace now that the woman who slowly poisoned him for money has been found guilty of murder, his father said Saturday. A Whitfield County jury convicted 38-year-old Lynn Turner of malice murder Saturday after five hours of deliberations. Evidence showed that Turner used tea and soup laced with antifreeze to administer a slow, painful death to the Forsyth County firefighter, and father of her two children, in January 2001... "We have such mixed emotions," said Thompson's father, Perry Thompson, as he addressed reporters outside the courthouse with about a dozen family members standing behind him. "The sadness is that three families have lost loved ones and are scarred forever. Our grandchildren have lost their father and now their mother, and it appears from the evidence, all for money... He can rest in peace now," Thompson said. "After six years of living a nightmare, it's just a tremendous relief to get this part of it over with"... Perry Thompson and Randy Thompson's mother, Nita, lowered their heads and cried quietly after the jury foreperson announced the verdict... The prosecution's case was entirely circumstantial... [OH] Officer Hartless' alledged brutal domestic violence attack wont't be called domestic violence? It's just disorderly of him.

Also in August:

He was charged with disorderly conduct, a fourth-degree misdemeanor.... "At first he grabbed me by the hair and threw me on the ground, kicked me between the shoulder blades while screaming at me"... Officers documented bruises, scrapes and cuts on the girl's body. A boy notified the girl's mother about the fight via text messages and sent a picture of the bruises to a relative... a domestic violence charge would be problematic because of the victim's credibility... A domestic violence charge would have meant Hartless had to turn in his firearms, but because Hartless was charged with disorderly conduct...

No charges filed by deadline; man released from jail

[Excerpts] A Newark police officer spent Wednesday night in jail after he was arrested on suspicion of assaulting a 17-year-old girl. Newark Law Director Doug Sassen appointed attorney Christopher Shook to review the case and determine what charges, if any, should be filed. The officer was released from jail Thursday after no charges were filed by the 11 a.m. deadline, Sassen said. People arrested must be charged and arraigned the following business day or be released. A 17-year-old girl reported the officer and a boy assaulted her Wednesday evening... Because the officer has not been charged, he will return to work Sunday... [Full article here]

Newark police officer accused of domestic violence still on duty
City's handling of allegations involving employee lengthens process

The Newark Advocate
By Jessie Balmert
August 13, 2010
[Excerpts] A decision about possible charges against an off-duty Newark police officer accused of domestic violence has been delayed more than a week after his arrest in an effort to avoid a conflict of interest, according to Newark's law director. The delay has given the officer time most residents facing similar allegations are not allotted and other area law directors said they would not give... The girl alleges the officer punched her in the side of the head, slammed her against a wall and kicked her repeatedly... "At first he grabbed me by the hair and threw me on the ground, kicked me between the shoulder blades while screaming at me"... Officers documented bruises, scrapes and cuts on the girl's body. Newark police officer Bobby Hartless taken off patrol
Newark Advocate
By Amy Hollon
August 21, 2010
[Excerpts] Officer Bobby L. Hartless Jr. was placed on indefinite administrative duty Friday pending the outcome of a criminal case and subsequent internal investigation by the Newark police department... According to a press release, special Law Director Christopher Shook told the police department a domestic violence charge would be problematic because of the victim's credibility. But until the criminal matter is resolved, Police Chief Steven Sarver said Hartless will not be on patrol. His police powers have not been stripped, however. The main reason for that, Sarver said, is Hartless still has several court appearances scheduled. Sarver said he did not think it would be in Hartless' best interest to take away his ability to defend himself. A domestic violence charge would have meant Hartless had to turn in his firearms, but because Hartless was charged with disorderly conduct, Sarver has contacted the law director's office for an opinion about whether Hartless' gun needs to be taken away... Initially, when The Advocate requested public records pertaining to Hartless, it did not receive materials from the internal investigation conducted against Hartless in November. When The Advocate filed a second request for the specific document, it was told the file was kept in a locked file cabinet with just one key that only Sarver could access... [Full article here]

Officer's case reveals good, bad of city government
Newark Advocate
August 22, 2010
[Excerpts] ...It took a week for the city to produce the officer's personnel file, which was too long. Any resident should be able to walk in and inspect the file with minimal delay, although the city does have to redact some personal information under law. Even worse, the city continues to keep disciplinary information in a separate file at the police station a block away when it should be included in more complete form in the employee files. We found just a notice of suspension and learned the documents explaining the suspension were in Chief Steven Sarver's locked cabinet while he was out of state, and no one else knew where to find the key. Knowing Newark keeps two files, our records request specifically requested disciplinary information. It was ignored in clear violation of Ohio law. Only when our patience with City Hall grew thin did [Mayor Bob] Diebold take our request seriously and magically find some documents in Safety Director Roger Stollard's office. It would be laughable if it were not so serious... [Full article here]

Published: Aug. 29, 2010

Police officer Stephen Peterson was suspended after saying his father, Drew Peterson, stored guns at his Illinois home, a source told the Chicago Tribune.

The newspaper said Sunday that the younger Peterson, an officer with the Oak Brook police force, told department investigators last week that he allowed his dad to keep three guns at his home shortly after Drew Peterson's wife, Stacy, disappeared in 2007.

Drew Peterson is currently charged with murder in the 2004 drowning death of his third wife, Kathleen Salvo. The former Bollingbrook police sergeant is considered a suspect in Stacy Peterson's subsequent disappearance.

Stephen Peterson told investigators his father asked him to hold on to the weapons because did not want anything to happen to them, the Tribune said. He later turned them over to the state police.

Drew Peterson's attorney, Joel Brodsky, told the newspaper the suspension was "baseless" and was aimed at his client.

[FL] High Springs police officer Michelle Jones finds another way to stand up for herself as a victim of domestic violence

Officer's husband wants answers
Alachua County Today
Glenn Coine
Sunday, 29 August 2010

It’s been over a year since High Springs police officer Michelle Jones, formerly Michelle Kemp, filed a formal written complaint against Chief of Police Jim Troiano.

The file for the Aug. 3, 2009 complaint is still open, and any investigation that was initiated has yet to be officially closed.

Alachua County Sheriff’s Deputy Brandon Jones, Michelle’s husband, explained that because her complaint is still active and open, she is not at liberty to discuss the issue, which is why he spoke on his wife’s behalf at an Aug. 12 city commission meeting.

When the commission opened the floor for citizen comments pertaining to items not on the agenda, Brandon Jones came forward, explaining wanted to make the commission aware of the lack of adequate action taken about his wife’s complaint.

Mayor Bill Coughlin and City Manager Jim Drumm urged Jones to hold off on addressing the commission with all the details, asking him first to meet with Drumm to discuss the matter.

Jones wanted to ensure that everything said, both by him and by Drumm, would be subject to public record, and he agreed to meet with Drumm the following Wednesday, Aug. 18, on the condition that he may record the conversation.

Incident happened in Gilchrist County

During the Wednesday meeting, Jones elaborated on the details of his and his wife’s concerns.

The complaint she filed last year was in objection to actions taken by Troiano regarding an incident of domestic violence that took place in Gilchrist County between Michelle and her brother.

According to Brandon Jones, after being the victim in an altercation with her brother, Michelle Jones notified the chief of the incident out of professional courtesy and honesty because she had nothing to hide.

When she informed Troiano of the incident, he requested that she provide him with a brief memo to be placed in her personnel file.

Subsequently, he also placed a copy of the sheriff’s report from the incident in her file.

Her complaint protests the necessity of this action, since she claims she was the victim and not the aggressor in the altercation.

Additionally, the complaint addresses a statement the chief made while under oath during a July 7, 2009 interview that was part of an investigation pertaining to an unrelated sexual harassment complaint against him, and the comments he made to a local media outlet when answering questions about the results of an anonymous survey done by the Police Benevolent Association, Jones said.

Victim or Aggressor?

The concern, he explained, was that Troiano was discussing an issue directly pertaining to a separate open investigation, and second, that Michelle was at some point believed to have been the primary aggressor, rather than her brother.

Jones said there was never any reason to believe his wife was anything but the victim, and he said the police report from the incident supports that.

It is misleading and defamatory, he explained, to say she "threw the first punch." There is a big difference between putting ones’ hands out to push someone away in self-defense, and thus making the first physical contact, as Michelle did, and "throwing the first punch," he said.

The incident report, which is a public record maintained by Gilchrist County, names her brother as the primary aggressor.

According to an audio recording of the interview in question provided by the city, Troiano said "Michelle Kemp was involved in a domestic disturbance with her brother. She was at one time the primary aggressor, and was going to be arrested and charged by the Gilchrist County Sheriff’s Office, according to her. She later told me after her mother testified that she became the lesser of the two and became the victim."

He went on to say, "There are policies and procedures that require that we document that. My purpose of getting that memorandum was to follow this because she used force, she punched her brother…bottom line is she’s the victim."

He then said, "But I asked for that documentation, and I also obtained a copy of the arrest report and the police report…I feel that we have a responsibility to protect our officers."

Jones said his wife was never actually a suspect, but she might have mentioned to Troiano that during a phone conversation directly following the incident, the Gilchrist County sheriff involved told her jokingly that she was lucky her mother was there to attest to her innocence.

The chief pointed out that he never used her name when responding to a request by a local media outlet, and he stands by his statement that she was the first to use force no matter how you look at it.

This is why, he continued, he had a responsibility to keep a record of the incident. He did so, he said, with the interest of protecting his officer, should she later be accused of questionable actions. He said because he kept the report on file he would then easily be able to defend her and prove her innocence.

Troiano said he wanted to make it clear that he does not, nor did he ever, have any intention of targeting any employee or of maligning an employee to the media.

Deputy Jones said his primary purpose in bringing the issue to the city commission and then in meeting with Drumm, is to ensure that an investigation will be re-initiated, and following the conclusion of the investigation, the complaint will be officially closed.

Jones questions policy

One of the questions he asked Drumm was regarding another High Springs police officer who was involved as a suspect in a domestic violence call at his home within the city limits. Jones asked Drumm why nothing was placed in this officer’s file, given the circumstances, but the documents from Michelle’s incident were included.

Jones said he felt Drumm did not give a clear response to this inquiry. However, Troiano spoke to the issue, stating that in the other case, there was never any physical contact made by either party. It was only a verbal domestic dispute, and no arrests were made, but specifically because there was no issue of physical force being used, it did not require the same documentation.

Drumm did, however, state that he had now removed the documents pertaining to the incident between Michelle and her brother from her file.

He also said there would be a new investigation made regarding the complaint, but there may be some delay caused by the process of selecting an independent agent to investigate.

Before the Wednesday meeting, Drumm said that part of what may have caused the delay in completing the original investigation was the fact that it was handled by the Bunnell Police Department at the request of the City of High Springs. Upon reporting back to Drumm, the investigator indicated that the findings did not warrant any further investigation.

Drumm said he wants to be overly cautious and ensure that everyone is treated fairly.

This was why he came to the commission, said Jones, to request that the city complete the investigation properly and to its fullest ability.

Troiano said he welcomes this and any investigation, because he knows he has done nothing wrong.

At this point, Drumm emphasized that the new investigation will not explore the question of whether the incident report should have been placed in Jones’ file, as it has since been removed. This investigation, Drumm said, will address two things: "what he [Troiano] said, and was he purposefully untruthful."

[CA] Deputy Mathis fired but since he was never arrested for attacking wife in front of cops - is this just a strategy?

Merced County Sheriff's Deputy Johnny Mathis attacked his wife, was never arrested, and after a brief bit of time off was back on duty. This "alleged" attack happened in the presence of other officers. I suspect that his firing is actually protecting him from a completed internal investigation. If there's no report and the blue wall of silence kicks in, there will be nothing to keep him from coming back or being hired at another law enforcement agency.
