[Excerpts] A former Georgia sheriff's deputy convicted of murder in the slaying of his wife and a day laborer in 2008 was sentenced Friday to two consecutive life sentences plus five years in prison. That means that Derrick Yancey, 51, will have to serve at least 60 years before he is eligible for parole. He stared straight forward and showed no emotion as a Superior Court judge imposed the sentence... Referring to Linda Yancey, Judge Linda Hunter said, "She was an officer, she was a wife, she was a mother, she was a daughter, she was a sister, she was a friend. Mr. Cax-Puluc, who had barely began to live his life, he died that day. It's not lost on the court, and probably yourself, that today an officer has fallen because you were a law enforcement officer entrusted with so many responsibilities"... Speaking on behalf of his family, Linda Yancey's brother, Eugene Thomas, addressed Derrick Yancey, a father of two, directly. "You had just killed the mother of your two children. An ex-DeKalb County Sheriff’s deputy convicted of killing his wife and another man, will be 111 before he is eligible for parole. Derrick Yancey, 51, showed no emotion Friday as Superior Court Judge Linda W. Hunter sentenced him to 65 years in prison. He must serve two life sentences – 60 years – before being eligible for parole... “Mr. Yancey, I’ve known you for a long time,” the judge said before issuing her ruling Friday. “June 9, 2008, an officer fell that day. Ms. Yancey, she was an officer. … Today an officer has fallen. You were a law enforcement officer, entrusted with so many responsibilities. But we can’t go back and change the verdict of the jury.” On the day of the verdict, Yancey asked the judge to delay sentencing until his mother could be present. “Upon being convicted and found guilty he called for his mother,” Linda Yancey’s brother Eugene Thomas told the court. “I thought that was ironic since you had just killed the mother of your two children. [Excerpts] Thirty years of marriage for two high school sweethearts ended with a DeKalb County sheriff’s deputy [Derrick Yancey] shooting his wife point-blank in the heart, prosecutors told jurors Monday. A shot first hit Linda Yancey in the chest. Another ran through her neck and out her ear, before her husband pressed the gun into the center of her chest as she lay on the floor, prosecutors said. “That shot would blow away a portion of her heart,” Assistant District Attorney Ken Hutcherson said... On Monday, prosecutors told jurors that Yancey “executed” his wife and Cax-Puluc, lied to police, cut off his ankle monitor and then fled to Belize... Police testified that Yancey wasn’t considered a suspect. Investigators testified that Yancey was never handcuffed or detained when police responded to his 911 call. He told the dispatcher his wife had been shot and he needed instructions on how to do CPR. This ultimately helped raise officers' suspicions. Investigator Greg Johns, of the county medical examiner’s office, said Linda Yancey had no bloody handprints on her shirt nor any indication she received chest compressions. Prosecutors said they also didn’t know why Yancey, a trained officer who had completed several first-aid courses, needed 911 to tell him how to perform CPR... McMullin, the defense attorney, said her client was set up by police to alleviate pressure that officers were receiving during a grand jury investigation involving a high number of police-involved shootings. McMullin called the way her client was treated by police a "second tragedy"... The families declined to comment until the end of the trial. [Excerpts] Six months before she was killed, DeKalb County Sheriff’s Deputy Linda Yancey told her friend [Danita Huff] she was scared her husband would kill her, a fellow deputy said Wednesday... “Linda told me on several occasions that she was upset with him and told me that he would shoot her and kill her”... Defense attorneys objected to Huff’s testimony, calling it hearsay. A judge is now deciding whether it can be part of the case... Yancey has remained silent throughout the trial. On Wednesday, he stared straight ahead as he listened to a recording of the 911 call he made that afternoon. Jurors listened as the 911 operator instructed Yancey how to perform CPR. “He shot my wife. Please hurry,” he cried on the call. “Linda, please wake up.” During the middle of the call, Yancey stopped performing CPR and went to look for police. The 911 operator testified Wednesday that it is “unusual” for someone to walk away in the middle of giving CPR. [Excerpts] Despite claims of self-defense, a former DeKalb County Sheriff's deputy [Derrick Yancey] will not testify at his murder trial... On Thursday, the prosecution rested its case and the defense put up several witnesses, including the defendant’s mother [Barbara Jordan]...“I had noticed that he was very, very depressed. I would try to conversate with him, but he talked very little,” she told jurors... The mother made no other statements and the defendant’s only other witnesses testified for less than an hour. Earlier Thursday, defense attorneys asked the judge to acquit Yancey, alleging prosecutors did not present any evidence that he killed his wife. However, Superior Court Judge Linda W. Hunter refused... Danita Huff, a fellow detention officer and friend of Linda Yancey, said the wife complained six months prior to her shooting that she was scared her husband would shoot her. But the judge called her statements hearsay and refused to allow them into trial. “They just want to offer it because it sounds bad,” defense attorney Letitia Delan said. “This is nothing more than a speculative statement made in a vacuum.” [Full article here]

[Excerpts] ...[Guatemalan day laborer Marcial] Cax-Puluc’s childhood friend and roommate, Edvin Xujur, testified his friend didn’t even know how to use a firearm... [Detective Hilton Stafford] said the day laborer was seven to ten feet away when he started shooting, but a forensics expert testified Tuesday that Yancey couldn't have been more than 10 inches away when he shot Cax-Puluc... One family friend said Linda Yancey feared her husband Derrick might kill her. DeKalb County sheriff’s deputy Danita Huff told the courtroom that Linda Yancey was afraid her husband might hurt her. "She told me that he would shoot her, and he would kill her," said Huff, though he had not made a specific threat against his wife. But the jury never heard any of Huff’s comments. Superior Court Judge Linda Hunter said it was too late in the trial to introduce what the defense called "heresay evidence"... Yancey's eldest son testified about his parents' rocky relationship. Ruth McMullen told jurors that Cax-Puluc is the real villain and tried to rob the Yanceys to pay back $6,000 he owed to the people who smuggled him into the U.S. just a month before he was killed. A former DeKalb County Sheriff’s deputy brutally killed his wife and a day laborer, shooting both of them several times in a staged robbery, a jury found Wednesday. The jury returned four guilty verdicts against Derrick Yancey... Sentencing has not been scheduled. Yancey asked for it to be delayed because his mother was not in the courtroom... After waiting those three days, Cax-Puluc’s older brother, Jose, said he was eager to call their mother in Guatemala. “My mother said she wanted justice. My brother didn’t know anything about guns. Yes, we feel there is justice now”... Linda Yancey’s family declined to talk to reporters, saying they wanted to wait until after sentencing. They are discussing a possible civil suit. Prosecutors spent last week telling jurors how Derrick Yancey shot his 44-year-old wife several times in the chest and once in the neck before a final shot as the gun was pressed into her heart. “That shot would blow away a portion of her heart,” Assistant District Attorney Ken Hutcherson told jurors last week... Yancey staged the scene to look like Cax-Puluc, a 20-year-old laborer from Guatemala, robbed the wife... Prosecutors say that was just a story he used to cover up the murders. [Excerpts] Blood found on a former DeKalb County Sheriff’s deputy shows he shot his wife, a GBI crime analyst testified Tuesday. Former deputy Derrick Yancey, 51, is on trial on charges he killed his wife, Linda Yancey, and day laborer Marcial Cax-Puluc ... GBI Special Agent Cecil Hutchins told jurors that blood splatter found on Derrick Yancey’s feet, shins and between his fingers are consistent with the wounds on his wife’s body ... Linda Yancey was shot in the chest, neck and in the heart with the gun pressed into her chest, prosecutors said... On Monday, a DeKalb police officer, who was the first at the scene of the shooting in June 2008, testified that Derrick Yancey was holding a gun when the officer arrived. The officer said he ordered Yancey to throw the gun on the lawn, but said he didn’t suspect Yancey was the shooter. Prosecutors said Yancey “executed” his wife and Cax-Puluc, lied to police, cut off his ankle monitor and then fled to Belize. Marcial Cax Puluc is the man who is believed to have been killed as a part of a contrived story Deputy Yancey told authorities, as a cover-up in his (premeditated?) murder of his own wife, Dekalb Sheriff's Officer Linda Yancey. Marcial is more than a dead prop. He was a young man with a family who loves him - who was here to help them by earning money to send home. Linda was much more than a wife. She's a mother, sister, friend, and missed Dekalb Sheriff's Officer co-worker. Her sweetness lingers heavy in the air over all of this.

[Excerpts] Former DeKalb County sheriff's deputy and now fugitive murder suspect Derrick Yancey escaped Atlanta on a westbound Greyhound bus and then vanished somewhere between Phoenix and Los Angeles, Sheriff Thomas Brown said Thursday. Yancey, who worked in the DeKalb County Jail until a year ago, is accused of shooting his 44-year-old wife and a day laborer. At the time, Yancey claimed he shot 20-year-old Marcial Cax-Puluc after the Guatemalan immigrant shot and killed Yancey's wife, Linda, during an attempted robbery at their home. His story fell apart and Yancey was charged with two counts of murder. He was released on $150,000 bond and ordered to wear an ankle bracelet monitor. Police say Yancey removed that ankle bracelet at 5:41 a.m. April 4 and left his mother's Clayton County house... The first image recorded Yancey, using the name "David Brown," at the Atlanta bus station at 7:10 a.m. buying a ticket to the West Coast. Other bus station cameras tracked Yancey to Dallas, to Amarillo, Texas, and then to Phoenix, where he transferred to a 12:40 p.m. Greyhound to Los Angeles. Yancey was not seen after that because the four stops on the route to Los Angeles did not have cameras, Brown said... Yancey might have headed into Mexico, considering he's fluent in Spanish... A $10,000 reward is being offered for his capture and the television show "America's Most Wanted" (9 p.m. Saturdays on Fox) will broadcast an unscheduled segment... The sheriff said family members also might have helped Yancey get away and, if they did, they will be charged. Investigators suspect Yancey may have altered his appearance... The video from the Atlanta bus station showed him with a new mustache, longer hair and the beginnings of a beard... Most likely, the sheriff said, Yancey will be captured during a traffic stop. Security guards at the bus station didn't even notice him, and with good reason -- Yancey had quite the head start on authorities. Officials said he had cut off his ankle monitor, but 11 hours would pass before the monitoring company would report the breach to authorities. He was last spotted at a bus station in Phoenix, Az. Authorities believe he could be anywhere between Phoenix and Los Angeles or even in Mexico. "We do know that he is quite proficient in the Spanish language," Brown said. Yancey's wife Linda, who was also a DeKalb County deputy, and a day laborer were shot to death in Yancey's home in Stone Mountain in June 2008... [GA] "Resigned" Deputy Yancey indicted for double murder of Linda and Marcial.

..."This is a case that's going to lean heavily on the forensics and ballistic evidence, which we have quite a bit of, and it's powerful. It will prove beyond a reasonable doubt what we've thought all along - Deputy Yancey's guilty"...

A DeKalb County grand jury indicted Derrick Yancey yesterday on 2 counts of murder in the June 9 shooting deaths of his wife, DeKalb County Detention Officer Linda Yancey, and day laborer Marcial Cax-Puluc. Deputy Yancey resigned last month before this month's charges.

Prayers are lifted for all family members and friends of Linda, Marcial, Derrick, and the law enforcement officers who are seeing this through professionally despite their own disappointment in what appears to be the outcome .

A former DeKalb County sheriff’s deputy has been charged in the June 9 shooting deaths of his wife and a day laborer killed in the deputy's home. Derrick Yancey turned himself in to authorities on Thursday. [Excerpts] DECATUR, Ga. -- A grand jury returned an indictment Thursday charging a DeKalb County Sheriff's deputy with two counts of murder in the deaths of his wife and a day laborer inside his home last June. A grand jury warrant was issued for the arrest of Derrick Yancey, who turned himself into the DeKalb County jail Thursday afternoon. Yancey was searched personally by Sheriff Thomas Brown, booked, and then moved to an undisclosed jail for his own protection. Assistant District Attorney Don Geary said Yancey, who resigned from the department last month, was informed of the indictment about noon Thursday. Yancey claimed that Marcial Cax-Puluc was an intruder who shot and killed his wife, Linda, during a robbery attempt inside the couple's two-story brick home on June 9. Yancey said he then killed Cax-Puluc, who had arrived in the United States just six weeks earlier from Guatemala... The indictment also charges Yancey with two weapons offenses of possession of a firearm during the commission of a felony. Linda Yancey, 44, was a DeKalb County detention officer for 13 years who most recently worked in the juvenile intake section... Somebody tell me WHY anyone suspected of murdering his wife and an uninvolved day laborer would be on house arrest!

The sheriff's office said on Saturday it assumes that Derrick Yancey is desperate, armed and dangerous. The DeKalb County fugitive squad is looking for the 49-year-old suspect. Yancey was indicted in August in the fatal shootings of his wife and a Guatemalan day laborer who he claimed had killed his spouse at their Stone Mountain home. Prosecutors say Yancey fabricated the story about the June 9 shootings. Yancey was released after his August arrest on $150,000 bond and placed under house arrest. A former DeKalb County Sheriff’s deputy, out on bond as he awaited trial in the deaths of his wife and a day laborer, has gone missing, authorities said Saturday. The sheriff’s office’s fugitive unit is looking for Derrick Yancey... “He was [on] an electronic monitor and was restricted to the house,” [sheriff’s spokeswoman Lt. Billi] Akins said late Saturday night. “We received info that he cut the bracelet off and left his residence.” Yancey was indicted and arrested in August for the June shooting death of his wife Linda, 44, and day laborer Marcial Cax Puluc, 20... The court ruling last August allowing Yancey to be released drew a sharp response at the time from his wife’s siblings. In a statement, lawyer Loletha Denise Hale, who said she spoke for Eugene Thomas and Gloria Thomas Sanders, accused prosecutors of giving Yancey “preferential treatment as a result of his previous employment with the DeKalb County court system”... Akins said Sheriff Thomas Brown is taking Yancey’s disappearance seriously because of the deaths involved. “We’re concerned that he is desperate and may be armed and dangerous,” she said. The murder case of ex-DeKalb County sheriff's deputy Derrick Yancey is getting a new judge. Yancey, 49, is accused of killing his wife and a day laborer in his home June 9. He claimed he shot the laborer after the laborer killed his wife during an attempted armed robbery. The district attorney's office wanted all DeKalb County judges to step aside because Yancey had often worked in the courthouse. Superior Court Judge Anne Workman refused. The state Supreme Court upheld her ruling, but the appeal process delayed preparations for a trial. Workman filed an order last week saying she was concerned she would not be able to complete Yancey's trial before her retirement takes effect Dec. 31. The case now is before Superior Court Judge Linda Hunter. [LINK]

This short article's author didn't mention the names of Deputy DY's (alleged) victims. That has to be wrong. (It just has to be.) May these two stolen lives never be considered incidental in the prosecution or coverage of this case.

Former DeKalb County sheriff’s deputy Derrick Yancey can await his double murder trial under house arrest and a $150,000 bond, a judge ruled Thursday.

The ruling drew a response from a representative for two siblings of Yancey’s wife, whom Yancey is accused of killing. An attorney who said she spoke on behalf of the siblings of Linda Yancey said the DeKalb district attorney’s office failed to do enough to prevent Yancey’s release.

“It appears Mr. Yancey is receiving preferential treatment as a result of his previous employment with the DeKalb County court system,” said a statement issued by lawyer Loletha Denise Hale, who said she spoke for Eugene Thomas and Gloria Thomas Sanders.

Asked about the statement, chief assistant district attorney Don Geary said Yancey “will be treated as any other criminal defendant charged in DeKalb County. We will vigorously prosecute within the limits of the law, and we will do everything we can to be mindful and considerate of the wishes of the victims’ family.”

Linda Yancey, 44, and day laborer Marcial Cax Puluc, about 20, were killed at the Yanceys’ home near Stone Mountain June 9.

Yancey told police that Cax Puluc killed his wife in an armed robbery attempt, forcing Yancey to shoot him. But authorities say lab tests showed Yancey shot both victims.

Derrick Yancey, 49, escorted prisoners to appearances in the county courthouse for 11 years until he was placed on leave because of the shootings. He resigned Aug. 11 and was jailed Aug. 14, when a grand jury indicted him.

Superior Court Judge Linda Workman issued a bond order Thursday, specifying that Yancey must wear an ankle monitor and leave his mother’s Clayton County home only for legal or medical appointments.

Workman’s order quoted a Georgia law which makes defendants eligible for release on bond if they pose “no significant risk” of fleeing, intimidating witnesses or committing other crimes. Unlike many other states, Workman wrote, Georgia does not further restrict bond for murder defendants unless they have been convicted of a prior violent crime.

Geary opposed bond in a Wednesday hearing, telling Workman that Yancey became more of a risk to flee after quitting his job and placing his 8-year-old son with his mother. Workman’s order noted, however, that Yancey had taken those steps before his indictment and still reported to jail voluntarily when an arrest warrant was issued.

Geary did not offer evidence about the shootings or suggest that Yancey might be a threat to others.

Defense attorney Keith Adams said Thursday he expected it would take “a couple of days” to arrange the bond and electronic monitoring. Yancey is being held in an undisclosed jail.

Yancey was a 17-year veteran of the sheriff’s office. Linda Yancey also worked for the sheriff’s office for 13 years, most recently as an intake officer in Juvenile Court.

Workman’s order said she expects Yancey to be tried by the end of the year.

The wife of a DeKalb County sheriff's deputy was laid to rest Saturday. Linda Yancey was shot and killed in her Stone Mountain home Monday. Yancey's husband said her killer was a day laborer he hired for yard work. The pain and sadness was at times obvious as mourners exited the funeral of DeKalb Co. Detention officer Linda Yancey at Ray of Hope Church in Decatur Saturday. Yancey was killed Monday when her husband, DeKalb County Sheriff's Deputy Derrick Yancey, said a day laborer shot her multiple times during an attempted robbery. The laborer was later shot and killed by Derrick Yancey. For life long friends Sherri and Janice Thompson, the hurt and shock of Yancey's death was a heavy load. "It's killing me. It's really, really hurting. I'm just sorry to see her go," said Thompson. Both the Thompson sisters said Yancey was a great friend. "She always had something wonderful to say to someone and she always made you feel loved," said Thompson. DeKalb county police are handling the homicide investigation. Police Chief Terrell Bolton said the case was far from closed and no one had been ruled out as a suspect. The Thompson sisters said no one at Saturday's funeral was focused on the police investigation. Their focus was strictly on Yancey's life and memory. "She's a good person and I know she's in a better place now. She's going to be missed," said Thompson.
