[Excerpts] A Lorain police officer with a history of problems with alcohol resigned earlier this month during an investigation into allegations that he was drunk on the job while working on Feb. 8. Lorain Safety Director Phil Dore said Jack Brown’s resignation took effect April 2 and Brown took retirement after 20 years on the job... Brown was relieved of his duty weapon and was placed on administrative leave... “It would be very difficult to successfully prosecute him for a criminal charge,” [Sheffield Lake Law Director David] Graves said. Brown also was never punished because he resigned before any action could be taken. Brown was suspended for 30 days in 2008 for showing up to work under the influence of alcohol... Brown received an additional three-day suspension in 2008 for an off-duty domestic violence incident in 2006. Discipline in that case had been held in abeyance pending Brown’s good behavior. Brown received another three-day suspension in 2008 after he was accused of spitting on his fiancee’s niece during a July 4, 2008, party where he was also accused of using racial slurs and swearing. He also was punished for taking time off for a medical appointment even though his request for the time off had been rejected. After Brown was punished for that incident, Lorain Police Chief Cel Rivera ordered Brown to continue to receive alcohol treatment and to submit to random tests for alcohol until the end of 2009. During his first year on the force, Brown also ran into trouble when he and another off-duty officer were caught shooting at road signs and streets lights after visiting two bars while office duty. Although they were charged with criminal damaging for that incident, both officers kept their jobs and received three-day suspensions... [Full article here]

Among the problems Graves listed was a lack of evidence warranting a breath test... no one actually saw him driving... In January 2009, Brown served a 30-day suspension for being intoxicated while on duty, according to Lorain police records. In December 2008, Brown served a three-day suspension for an off-duty incident where he showed up at a family member’s house highly intoxicated and yelling racial slurs. In November 2006, he was arrested by Lorain County sheriff’s deputies for domestic violence charges filed by his wife. In April 2006, an ex-girlfriend of Brown’s filed a menacing complaint against him with Elyria police. Lorain police Chief Cel Rivera did not return calls for comment. [Full article here]

...Lt. Geno Tailano, Sgt. James McCann, and Cel Rivera were making decisions way back in 1998 about Jack's domestic problems, insubordiantion, inappropriate behavior, stress level, and concern that he get help for his "unreasonable behavior before his family and work life is jeapordized any further." How did this go on for so long?...

...Let me understand: this happened in February and it only comes to light now, AFTER his retirement! The system worked for him like it has for so many others. Excuses do not make this better. The officers in charge allowed him to "go out on patrol" then changed their minds. Are you kidding me!...

...I know if I went drunk to my job i'd get fired. theres no resigning. There's no retirement. This guy has been in the news many times, and all he got was a slap on the wrist. Now our taxes are going to pay for this jerk to retire?...

Jack Brown was called back but didn't respond they couldn't find him, UNTIL someone from the beverage store called and asked them to send a cruiser over there and get jack out of the bathroom. He had passed out in the bathroom and was in there for two hours before the department was called. So give us a break with the cover up. He should have been fired that day and was going to be but they changed their little minds and let him retire. I guess if he was puerto-rican he would have been brought up on charges and fired. That department are nothing more than racist pigs from the chief down...

...First off, he was driving a car drunk second, he is carrying a weapon under disabilities. The last time he went on a call drunk and the resident that he went to the call for called the department and complained that is why he was tested...

...Why didn't the department investigate like they did for other officers? Why haven't they forced other to testify against him like they have another officer that is about to go to court soon? He was working and is facing charges not drinking and driving or carrying a weapon under disabilities...

...Lets take a look at who else should face those charges: Dore, Dennis Will, Arendt, and almost all firemen that call off and work side jobs. Why wasn't this case sent to Wills office?

...I am the ex family outing he was at swearing , drunk, and yelling racial slurs. I called the police and it was reviewed but he got 3 days suspension for actually spitting on my then 14 year old daughter. Things do have a way of coming back on ya Jack...

...Brown has had issues with alcohol for years. In fact, since he came on the department almost twenty years ago. There were complaints, that Jack in the past, would go into bars in Amherst, allowing his firearm to be seen ect.., Also, he got into it, with Joe Kucherik from Amherst PD over a speeding violation. I guess what I am trying to say, is Jack never really got any help to deal with his problems. But, I still believe, he put the citizens at risk by coming to work drunk, and his fellow officers. Was his firing warranted? or were criminal charges waranted. Hard to say, but I do feel safer, that he's now working the road anymore.
One thing for sure, Rivera failed Jack miserably, in getting him help over the years. But hey, Rivera has had his own demons too"...

...Looks like LPD assiduously took every step necessary to ensure there would not be enough evidence to charge one of "their own"...
