[Excerpts] A Gainesville jury found a Golden Beach Police lieutenant guilty of kidnapping and battery on his wife in an incident that occurred last year. Lt. Roberto Barrio was found guilty in connection with the attack on May of last year. He is guilty of false imprisonment, kidnapping and battery... Barrio now faces up to five years in prison at his sentencing set for next month and the revocation of his police license... The CBS4 News investigation revealed that Barrio was charged with battering his wife during an assault in Newberry... Golden Beach Mayor Glenn Singer issued the following statement: "The town of Golden Beach affords all of its employees the right to due process.  Given the verdicts reached in this case, the town has relieved Lieutenant Barrio of all duties, effective immediately." [Excerpts] Golden Beach police lieutenant Robert Barrio remains on the job seven months after being arrested in Alachua county on charges of kidnapping, false imprisonment and battery. A CBS4 News investigation has revealed that Barrio was charged with battering his wife during an assault in Newberry... The police report says Barrio "grabbed (his wife) by her shoulders and threw her to the ground." The report says the officer carried his wife over his shoulder and "threw her" into the back seat of his GMC truck. When the wife ran from the truck back into the house, the police report says Barrio again "picked her up over his shoulder and threw her" into his vehicle. The report says the woman's screaming drew the attention of neighbors who witnessed Barrio "slinging and shoving" his wife into the car and "holding her inside the vehicle as he was driving away" with their children in the back seat.
When police stopped the car, they found the wife crying hysterically, with "noticeable red marks" on her body. Spencer Mann, a spokesman for Alachua County state attorney William Cervone, said prosecutors carefully reviewed the case and "made a conscious decision" to file the felony kidnapping/false imprisonment charge against the police officer, and a misdemeanor count of battery... Despite the serious charges against him, police chief James Skinner has permitted Barrio to continue in his role as a lieutenant in the department's "command staff." Barrio continues to wear a badge and pack a handgun as he supervises other officers, performs "administrative" functions and moonlights, in uniform, on off-duty jobs...
 The chief characterized the alleged domestic attack as "one of those situations that does occur from time to time"... Lieutenant Barrio's wife has been reluctant to cooperate with prosecutors, which experts on domestic violence say is not unusual. [Excerpts] A Golden Beach police lieutenant arrested last May on a felony charge was temporarily put on leave with pay and is currently doing administrative duties, town officials said. Records show Roberto Barrio, 39, was arrested in Alachua County in May and later charged with misdemeanor battery and false imprisonment in a domestic incident. Barrio had been working with a task force before the arrest, according to police chief Jim Skinner, who would not name the task force... Skinner said the fact that the apparent victim, Barrio's wife, had not requested an injunction against him ``played a part in our decision making.'' The case is pending a Dec. 14 status hearing, said Spencer Mann, a chief investigator for the state attorney's office that handles Alachua County... [Excerpts] A Golden Beach police lieutenant facing charges of kidnapping, false imprisonment and battery in Gainesville, has a history of previous allegations of violence, a CBS4 News investigation has revealed... CBS4 I-Team has learned this is not the first time that Barrio has been accused of violent behavior. Court documents show that in 2004, a previous wife sought and was granted a temporary restraining order, alleging he had behaved violently toward her and her son. "My husband has threatened to kill me," the woman wrote in court documents. "I fear for my life…I am afraid for my son's safety." A judge granted a temporary restraining order, and directed that Barrio surrender his weapons. The court later lifted the order after finding that there was "insufficient evidence" under state law to leave it in place. In a separate 2004 case, a police report was made regarding an alleged attack by Barrio on his 74-year-old father-in-law. An officer wrote in his report that the elderly man suffered "large bruises to his forearms," a cut on one arm and a "red mark" on the side of the face, where he had allegedly been punched. That battery case was later dropped. During a stint with the Gainesville Fire Department, Barrio came under internal investigation after a man alleged that Barrio had "threatened to kill" him and tried to "extort $10,000" from him, because of an alleged affair the man had with Barrio's wife. The internal investigation ruled the allegations were "not sustained," due to a lack of independent witnesses... While employed as a police officer at the city of South Miami, Barrio came under internal investigation for allegedly abusive, profane and racist behavior toward co-workers. Some members of a multi-agency task force that Barrio was assigned to said they found his conduct so objectionable that they did not want to work with him. Investigators found Barrio guilty – or "sustained" – five counts of violating South Miami department policy, including behaving unprofessionally and allegedly lying to investigators. Barrio denied all the allegations against him and quit the South Miami department before the case completely played out. South Miami notified state law enforcement regulators that Barrio had resigned "while under investigation." Golden Beach Police Chief Jim Skinner on Monday declined to discuss Barrio's prior history, saying he was not familiar enough with the officer's employment file and background investigation... Golden Beach Town Manager Alexander Diaz issued a written statement Tuesday saying: "Golden Beach is the fourth agency to investigate Lt. Barrio's background and employ him since he left the South Miami Police Department in early 2002. At this time, the Town is not altering its position on Lt. Barrio's employment... THIS is the city manager who defended keeping Barrio working despite the felony charges. It's included because I suspect that part of flagrant disregard for Barrios history and then-current allegations comes - at least in part - out of being quasi-criminal /criminal at heart themselves. Birds of feather. Honor amongst law breakers.

[Excerpts] Golden Beach town manager Alexander Diaz had a blue Christmas. Miami Beach charged the 31-year-old early Christmas morning with DUI when they say he attempted to drive away, drunk, after the car he was riding in was pulled over on Alton Road. Diaz was a passenger in the car that had been stopped for suspicion of DUI. As an officer administered a road-side sobriety test to the car's driver, police say Diaz came out of the passenger side of the car, cursing and smelling of booze. The arrest report says Diaz had "slurred speech, a staggered gait, bloodshot eyes…and extreme odor of alcohol." Miami Beach police spokesman, Det. Juan Sanchez, told CBS4 News that Diaz repeatedly told the investigating officer that he was the manager of Golden Beach. The police report quotes Diaz as saying, "You don't know who I am? I'm the city manager, Bitch!" Sanchez said Diaz "attempted to enter the driver's side of the vehicle, repeatedly, and was ignoring the officer's commands not to enter the vehicle." According to the police report, Diaz asked the officer, "What's your f---ing problem?" Police say Diaz got behind the wheel of the car, keys in hand, and was apparently about to drive away.... Diaz did not respond to CBS4's request to comment for this story, nor did Golden Beach Mayor Glenn Singer. Members of the Golden Beach town council also did not reply to messages from CBS4 News. The arrest of Golden Beach's town manager comes on the heels of a CBS4 News investigation last month that revealed police Lieutenant Robert Barrio has been allowed to continue working, despite felony domestic violence charges pending against him...
