Police: Man draws pistol, accidentally shoots wife
KATU, OR - Dec 18, 2007

...Tualatin police said it appears to be a horrible accident. According to police, 24-year-old Ryan Michael Osbrink called 911 to report the shooting at the couple's apartment at 6935 S.W. Nyberg St. about 10:30 p.m. When deputies arrived, they found the man giving his wife first-aid... Blog entry on Kimberly's Myspace Page: "Kimberly" POSTED the day of Kimberly's death, Tuesday, December 18, 2007:
This tuesday morning, there was an unfortunate accident and Kimberly passed away. She was at home with Ryan wrapping presents while he was practicing how to draw his gun for his new job as a Sherriff for Clark County. He had the gun in safety mode, but for some unknown reason that only God knows, it went off as she walked around the corner. She was rushed to the Emergency room at a near by hospital, but her injuries were too extensive to treat there, so they transported her to OHSU. She went in for emergency surgery and they stopped the bleeding. She was given 27 units of whole blood, but because her liver was not in full function, her blood would not clot, causing her internal bleeding to become too much work for her heart, which eventually failed. She died at 2:30am with her parents, Ryan, myself (Melissa Osbrink) and my parents by her side. Ryan is in a great debt right now and only wishes he could take back time and fix this entire situation. This is such an unfortuante thing to happen, and such bad timing.....but the Lord knows that it was Kimmy's time and that he needed her in heaven with him. Sometimes we cannot understand why these things happen and in our hearts we know she is in a good place. Please pray for Ryan, her family and ours as we are all in great pain over this situation. Thank you all for being great friends to Kimmy, she loved everybody in her life.

...Before Kimberly Osbrink, 23, died early Monday morning from a gunshot wound to her stomach, she made a statement to police about how her husband shot her. Police won't reveal those crucial words, but are saying that Ryan Osbrink, 24, drew his pistol from the holster when it "unintentionally discharged" hitting her as she entered the room. Police reached this finding after a two-day inquiry, but have revealed little about the incident, such as what Kimberly Osbrink said, the circumstances around the shooting, if the gun malfunctioned, or the contents of the emergency call... Kim Osbrink was married to her husband for three years and managed a pet services company in West Linn. She is described by friends as a compassionate person with a special love and skill with pets. She spent most of her time at work, at home with her husband, and doted over their English bulldog, Gus... Osbrink was awarded the Bronze Star for courageous actions in the line of duty when he braved fire to aid an injured Iraqi soldier in December 2005 and three days after that incident helped rescue Marines from a disabled truck as IEDs were exploding around the truck. One Marine, a friend of Osbrink's, died in the attack... Kim Osbrink's close friend and co-worker, Amber Nurmi, however, said she and many of Kim Osbrink's friends and fellow workers would not be questioning the way she died. "All I hope for is that in the end," she said, "is that Kim is remembered for the way that she was"...

...Washington County Deputy District Attorney Roger Hanlon said Wednesday that the investigation was nearing an end but couldn't say when it would be finished. He also wouldn't share the 9-1-1 call from Ryan Osbrink and wouldn't reveal what Kim Osbrink told police about the shooting before she died... A Marine Corps spokeswoman said Marines are rigorously trained to avoid accidental shootings. Prior to handling any weapon, every Marine is trained in and must demonstrate understanding of the safety rules...
  • Treat every weapon as if it were loaded;
  • never point your weapon at anything you do not intend to shoot;
  • keep your finger straight and off the trigger until you are ready to fire;
  • and keep your weapon on safe until you intend to fire.
Those four rules are "drilled into every Marine," Crabaugh said. "Adherence to the safety rules is strictly enforced at all levels"... A private service for those who knew Kim Osbrink will be at 2 p.m. Sunday at Portland's St. Luke Lutheran Church, 6835 S.W. 46th Ave...

Co-workers at Healthy Pet, where Kimberly Osbrink worked, start fund her 2-year-old

The West Linn Tidings, Dec 20, 2007

TUALATIN - On Tuesday, friends and co-workers of Kimberly Osbrink were still dealing with the shocking news of her death. On Sunday, Kimberly's husband, Ryan Osbrink, reportedly told police that he "unintentionally" shot his 23-year-old wife in their Tualatin apartment while he was practicing drawing his pistol from a holster.

Tualatin police responded to the couple's apartment on Nyberg Street after receiving a 9-1-1 call from the house at around 10:30 p.m. Officers reported finding Osbrink, 24, administering first aid to his wife.

Kimberly, who was a manager at West Linn's Healthy Pet for two years, was rushed by ambulance to the Oregon Health and Science University Hospital where she later died from her injuries. Police said she was shot in the abdomen.

Tualatin police are still investigating the fatal shooting. According to Tualatin police spokesman Capt. Jeff Groth, Kimberly did give a brief statement to the first responding officers, but police are not releasing that information.

"Our detectives have worked tirelessly on this case," Groth said. "It's been an emotionally draining case."

"You cannot write this article and put her in a good enough light," said Amber Nurmi, owner of Healthy Pet.

"Vibrant. Dedicated. Loyal. She's like family for all of us here. She truly is one of the most wonderful people I met in my life."

Nurmi said Kimberly Osbrink grew up in Lake Oswego. At the age of 15, she began working with Nurmi at Healthy Pet in Lake Oswego.

According to Nurmi, Kimberly and Ryan, a Marine who has served at least one tour in Iraq and in 2006 was awarded a Bronze Star Medal with combat distinguishing device, were married for three years.

But Kimberly's pride and joy was a two-year-old English bulldog named Gus.

Co-workers at Healthy Pet have set up a fund for Gus. Nurmi gushed that the dog was the light of Osbrink's life before acknowledging that to set up a fund for the dog could seem trivial, "but she loved Gus," Nurmi said.

Nurmi has been in contact with Ryan since the shooting, but she declined to comment on his well-being except to say that he was doing "how you would expect him to be doing."

Ryan Osbrink had signed an offer of employment with the Clark County Sheriff's Office. His first day of employment was to be Wednesday.

According to a Tualatin police press release, Osbrink's hiring has been delayed pending the outcome of the Tualatin police's investigation.

The weapon involved in Sunday's shooting was an H&K model USP, .45-caliber semi-automatic pistol that Osbrink personally owned, according to police.

Osbrink had not been issued any weapons or other equipment from the Clark County Sheriff's Office. Once Tualatin police complete their investigation, the report will be forwarded to the Washington County District Attorney's Office for review.

I knew both of them... Since high school. Kim was an amazing person, so kind and full of love. Very devoted to Ryan, despite how terribly he treated her. She worshipped him and would do absolutely anything for him. Even lie to cover for him. They need to look deep into this tragedy. I don't believe Ryan is innocent, let alone a hero.

  6. I knew Kim, but not really Ryan. Goodness, the pain is unbelievable. For those who are reading this story just because it is news--this girl was so amazing. She really did not have to even try to be sweet and beautiful. The circumstances do not make sense. I can hardly wrap my brain around it. She is missed and I hope she rests peacefully.

  7. It was not Kimberly Osbrink's time. And that is how we fool ourselves. This was caused by a person who should have known better doing something stupid. It's a stupid way to die and a waste of a meaniful life. The whole thing makes me both sad that a the life of a young woman with so much goodness ends so unnecessarily and mad that her husband, who violated every thing he was taught in the Marines about how to handle a gun, acted so recklessly. God had nothing to do with this. The responsibility lies with the husband.

  8. I AGREE. IT IS OFFENSIVE TO SAY THAT GOD WANTED HER. IT'S CRAZY. MELISSA OSBRINK - IF SHE IS REALLY THE ONE WHO WROTE THAT (AND NOT RYAN HIMSELF) MUST BE INSANE WITH CONFUSION, OR TWISTED WITH DENIAL.

AND RYAN'S WORDS POSTED TO THE SITE THE VERY NEXT DAY, AFTER HE GUNNED KIMBERLY DOWN, ARE NOT THE WORDS OF A HORRIFIED GRIEVING HUSBAND WHO WAS RESPONSIBLE FOR HER DEATH.

IF THIS WAS A LEFT OVER OF IRAQ, KIMBERLY MIGHT NOT HAVE EVEN REALIZED HIS INTENT.

RYAN WAS TRAINED TO KNOW GUN SAFETY, AND DID KNOW GUN SAFETY. THERE IS NOTHING BELIEVABLE ABOUT ALL THIS "POLICE BELIEVE IT WAS A TRAGIC ACCIDENT."

  9. this is a crying shame, Kim was the sweetest person I've ever met.No way this is an accident.Ryan knows way too much about guns for this to happen. Marine Corps News
Marine receives bronze star, mourns friend
    June 8, 2006; Submitted on: 06/16/2006 04:17:37 PM ; Story ID#: 2006616161737
By Sgt. Robert L. Fisher III, MCAGCC

MARINE CORPS AIR GROUND COMBAT CENTER TWENTYNINE PALMS, Calif. (June 8, 2006) -- Cpl. Ryan Osbrink received a Bronze Star Medal with combat distinguishing device June 8 for “courageous actions” in Iraq Dec. 4 and 7 while serving as a vehicle commander with Lima Company, 3rd Battalion, 7th Marine Regiment.

Osbrink said the award, while an honor, brings painful memories. The only Marine killed Dec. 7 during the event was Osbrink’s friend, 22-year-old Cpl. Joseph P. Bier, machine gunner, 3/7. Osbrink and Bier became friends while serving together on Marine Corps Security Forces in Bangor, Wash.

Clayton and Carol Bier, the parents of the deceased Marine, came from Centralia, Wash., to the award ceremony and met Osbrink. The loss of a good friend was hard for him and made the weight of the medal that much heavier, he said.

“It never really feels good to wear it, it makes me think of that night,” said Osbrink. “It’s still hard for me, but I guess that’s normal.”

According to the award citation Osbrink dismounted from his vehicle Dec. 4 while under fire and moved into a building to assist an injured Iraqi soldier until the casualty evacuation unit arrived. He then positioned his Marines to provide security as the Iraqi soldier was loaded into the evacuation vehicle.

On the evening of Dec. 7, Osbrink’s section responded as the company’s Quick Reaction Force to assist a seven-ton truck disabled by an improvised explosive device. Upon arriving at the scene, a second IED exploded, engulfing the truck in flames. Osbrink described the scene as a, “Flash of light, big explosion, lots of fire.”

“By the time I looked at them [the Marines in the truck,] boom. I opened the door and was on my way,” he said. “It’s hard. I want to believe that I thought of something, but I can’t… I didn’t have time to think.”

A fellow Marine, 2nd Lt. Muaro Mujica, platoon commander for Weapons Platoon, Lima Company, 3/7, said Osbrink was focused only on helping others that night.

“It takes some people a second to figure out exactly what they are going to do, Corporal Osbrink dismounts his truck, and he goes directly into the fire,” said Mujica. “There wasn’t anything going through his eyes but trying to save his fellow Marines.”

As Osbrink pulled the downed Marines to safety, the truck exploded a third time knocking everyone to the ground. Osbrink returned to his feet and ran back into the fire to help more Marines. He provided first aid, applied tourniquets and pulled them into his humvee.

When it was full, Osbrink got in the back and pulled another Marine into the humvee on top of himself to return as many Marines as possible. He talked to them, held their hands and reassured them through the whole ride.

“The whole way back I was just, ‘Come on, you’re going to make it,’” he said. “Holding their hands, I wanted them to talk to me, which was the most important thing to me, just to know that they’re still there.”

Mujica said he was proud to have served with Osbrink.

“He truly acted beyond the call of duty that day and every day he was in country,” said Mujica. “When bad things happen, you get to see Marines do incredible things. It was an honor and privilege to watch Osbrink that day.”

The award comes with the memory that every Marine there on Dec. 7 tried to help. Even the Marines who were hurt in the third explosion still tried to help those who were injured before them, said Osbrink.

“It’s not just about me, it’s about every Marine who was there,” he said. “I don’t want you to think I’m a man amongst men or a hero. Everybody was. Every Marine there that night was a hero.”

The Portland, Ore., native joined the Marine Corps for the training he would receive before becoming a police officer. Since he was a teenager attending Wilson High School he wanted to join a Special Weapons and Tactics unit. With the skills he would learn from the Marine Corps he hoped to achieve that dream.

Osbrink is now looking toward the future. He plans to return home with his wife, Kimberly, after leaving the Marines Corps and become a police officer in Vancouver, Wash. There he hopes to fulfill his dream of becoming a member of SWAT.

Re: Kimberly Lynn Osbrink - Death Investigation (TUP 07-4714)

    Dear Chief Barker:

On Sunday, December 16, 2007 at 10:25 p.m. Tualatin Police officers were dispatched to 6935 SW Nyberg Road, Apt. # R203, The 911 caller, Ryan Osbrink, requested immediate medical attention for his wife Kimberly, stating he had accidentally shot her. Dispatch remained on the line with Ryan until police arrived. .

Police found Kimberly with a gunshot wound to her abdomen. Kimberly was conscious but in great pain. Officer Quinn Black asked Kimberly what had happened. Kimberly responded, "He was practicing, it was an accident." As emergency medical was arriving, two other officers on scene heard Kimberly say, "It was an accident... he didn't mean to do it."

Kimberly was transported to OHSU where she died at 1:50 a.m. on December 17, 2008. The Oregon State Medical Examiner's Office conducted an autopsy on December 17 and determined the cause of death to be a single gunshot wound to the abdomen.

Tualatin Police Detective Kevin Winfield led the investigation into Kimberly's death. He was assisted by other Tualatin Police officers, as well as Washington County Major Crimes Team detectives from the Forest Grove Police Department and the Washington County Sheriffs Office.

Ryan Osbrink cooperated completely with the investigators. He provided investigators with repeated access to the scene of the shooting. He provided investigator's with a 'walk-through' of the shooting. He was interviewed/ interrogated extensively. His accounting of what occurred never varied. He provided releases for military, medical and employment records for

    PAGE 2

background investigation. Investigators spoke with employers, friends, relatives and the parents of both Ryan and Kimberly.

In the end, the investigation revealed no evidence that Ryan intended to injure or cause the death of Kimberly. Both the physical evidence at the scene, and the wound to Kimberly, is consistent with the account given by Ryan. The investigation reveals a happily married young couple with good friends and close, supportive families on both sides.

I have reviewed the investigation in its entirety. I visited the scene of the shooting with investigators. I have reviewed the Medical Examiner's report as well as Kimberly's OHSU records.

Most importantly, I have met personally with Kimberly's mother and father. I was quite impressed. They are both remarkable people. Ryan is apart of their family. They continue to maintain a close relationship with Ryan and are doing all they can to help Ryan in reconstructing his life. They think the world of Ryan and would be unhappy and upset to see criminal charges brought against Ryan in the tragic death of Kimberly.

The State will not pursue criminal charges in this matter.

There are valid arguments on either side of the issue of bringing negligent homicide or even manslaughter charges in cases involving the unintentional death of loved ones as a result of unsafe practices with handguns. That larger debate will always factor into the decision to pursue, or not to pursue, criminal charges in a particular circumstance. In this case, the decision is clear that the community as a whole would receive no benefit in a criminal prosecution. I not only respect the wishes of Kimberly's parents, but I also agree with their conclusion.

This letter concludes our review of Kimberly's death.

    Sincerely,

    Roger M. Hanlon
    Chief Deputy District Attorney

I said I and Kim's friends would not question the shooting while the investigation was ongoing, as I assumed the detectives would be thourough, and I didn't have to worry about the investigation while it was ongoing.

I spent a lot of time around him, and it is my firm belief that this was an accident. I just found out about this today from the parents of a mutual friend of Ryan's and mine, who died in Iraq. My heart goes out to Ryan, and Ryan and Kim's families. I can only imagine what he must be going through.

  17. In response to" Please take this post down":

This whole thing doesnt SMELL RIGHT! Kim deserves a voice....since she is dead and cannot speak. This site can be her voice until the truth is known.

  18. Although Ryan closed Kimberly's Myspace page so no one can see it after he realized that what he and his sister wrote there the day Kimberly was shot was being seen, he left his open and has quite a lot to say in his blog section about his suffering that he leaves open to be public.

  19. I have it - but don't care to post it publicly here on the blog.

  20. You need to remove this post. Kim was not a victim of domestic violence. She would be pissed that this is still here. Take this down, please.
