[Excerpt] An Arkansas State Police trooper pleaded not guilty to assault and-battery charges. Trooper Brian Garrett, 38, is charged with aggravated assault and battery in the second degree, both class D felonies. If convicted, he could receive a sentence of up to six years on each count... Garrett, a trooper assigned to the governor's mansion, is on administrative leave with pay... Garrett was placed on administrative leave after his wife filed for an order of protection against her husband on Dec. 11, 2007. The order of protection was later dismissed. Mandi Garrett of Bella Vista claimed in court documents that her husband had physically abused her. She also levied an allegation that he had been abusive toward her three children. Garrett is accused of threatening his wife by placing the muzzle of his duty revolver against her face... A detective with the Bella Vista Police Department, Mandi Garrett told police that on Nov. 15, 2007, her husband had been drinking beer and taking prescription medication. When he started to leave the home, she told him he shouldn't drive and asked why he had his gun and badge... Mandi Garrett claims her husband placed the muzzle of the gun against the left side of her face and replied," Just in case I need it." Garrett is also accused of physically abusing one of his stepchildren...

[Excerpt] ...An arraignment is set May 1 before Senior Circuit Judge Tom Keith. Garrett remains on administrative leave with pay... Garrett's wife, Mandi, reported domestic abuse in December to Bella Vista police... The aggravated assault charge is a result of the weapon allegation. Garrett hit the children so hard he left bruises and scratches and injured his hands, she also said, resulting in the battery charge. In addition to the criminal case, child abuse investigations are under way by the Arkansas Department of Health and Human Services, according to court documents. That department is allowed to enter and monitor the household at any time. A day care center made one report of abuse to the Child Abuse hot line. The Benton County prosecutor's office made another report based on Mandi Garrett's application for a protective order. Mandi Garrett filed for divorce in December and asked for the temporary order of protection. She later asked that a no contact order be changed to a "no violence order" to enable the family to undergo domestic violence, family and marital counseling. Garrett is not to live in the residence and must continue taking prescribed medications for anxiety and anger. Deputy Prosecutor Stephanie McLemore said Monday the state may file one additional charge of misuse of the Arkansas Crime Information Center system. An allegation that Garrett misused that system is still being investigated. Mandi Garrett told police her husband looked up men who were dating his former wife and looked up her own ex-husband...
