[CO] Officer Lambert's police officer wife (who sustained visible injuries) refused to cooperate and dv charges are dropped

...The district attorney's office dismissed misdemeanor charges of third-degree assault and obstruction of a telephone service against patrol officer Donnie Lambert. Lambert was arrested March 16 at police headquarters after at least two physical altercations between him and his wife...

[Excerpts] Prosecutors have dropped a domestic violence charge filed against a Pueblo police officer after his wife, also an officer, said she wouldn't cooperate with the district attorney's office. Officer Donnie Lambert faced a misdemeanor assault charge... It's not clear when the case was dropped. He had been placed on administrative leave but officials say he's back at work. Deputy District Attorney Shad Brown said in a court filing that Lambert's wife, officer Bernadette Lambert, told prosecutors she wouldn't honor any subpoena to appear in the case against her husband. [Excerpts] ...The district attorney's office dismissed misdemeanor charges of third-degree assault and obstruction of a telephone service against patrol officer Donnie Lambert. Lambert was arrested March 16 at police headquarters after at least two physical altercations between him and his wife, Officer Bernadette Lambert... According to court records, the district attorney dropped the charges because the "complaining witness no longer wishes to prosecute." But in his motion, Deputy District Attorney Shad Brown also noted the "victim indicates she will not cooperate with prosecution or honor any subpoena issued to her to appear in court." Failing to honor a subpoena can bring sanctions, including a contempt of court charge. That can trigger other ramifications, particularly for a sworn officer of the law. But Pueblo Police Chief Jim Billings said Friday that he's more concerned about actions than whatever Bernadette Lambert may have told the district attorney. "It's one thing to say it, it's another to actually do it," Billings said. Billings said if she went through with ignoring a subpoena it may have been a violation of her oaths as an officer... A Pueblo police officer, arrested last month on suspicion of domestic violence, is back on duty. Patrol Officer Donnie Lambert was arrested March 16 for reportedly assaulting his wife... Lambert was put on administrative leave after the arrest, and a judge also placed a restraining order on him, barring him from possessing weapons. That restraining order was revised by the court, allowing Lambert to return to work. His domestic violence charge is still pending in court. [LINK]

    [Excerpts] A former La Junta police chief [Charles Widup] who received a ride home from Pueblo police after they picked him up for driving drunk stands to benefit from other mistakes by officers... Koncilja said the plea was offered after police video showed officer Donnie Lambert violated protocols for administering breath tests. Officers are required to remain in the interview room and monitor a suspect during the intervals between tests in order to be sure that the suspect doesn't belch or vomit, which could bring up alcohol from the stomach and create a false positive on the machine. According to the court record, Lambert left the room on two occasions for a total of two minutes... Rather than being booked into Pueblo County jail, Widup, who currently serves as an investigator with the Colorado Department of Corrections, was driven home... [Full article here]
