[Excerpts] A Madera sheriff's deputy who is suspected of raping his wife and holding her against her will had a prior felony spousal abuse complaint, according to Fresno County Superior Court records. The 2007 complaint against Jerry Saldivar was dismissed after he attended Alcoholics Anonymous and anger management classes, records show. Now, the District Attorney's Office is considering new felony charges against Saldivar, stemming from a 911 call from his home March 1. Clovis police arrested Saldivar, 37, on suspicion of rape, a forcible act of sexual penetration and false imprisonment, all felony counts. Officers also arrested him on suspicion of preventing a 911 call from being made, a misdemeanor. Court records said he videotaped the alleged attack... The divorce file also contains a Clovis police report on a Dec. 31, 2006, incident that led to the 2007 felony spousal abuse complaint against Saldivar. Included in the file are color photographs of the woman's injuries, including a bruised eye. According to that police report, she told officers that Saldivar grabbed her by the neck and then pushed her to the floor and sat on her. She tried to call 911, but he knocked the phone out of her hand and threatened her, the police report said. Spousal abuse charges were filed Jan. 5, 2007... The case was dismissed Oct. 11, 2007... The couple will return to court April 1 to determine whether the restraining order should remain in effect. Madera County sheriff's spokeswoman Erica Stuart said the law prevents her from talking about Saldivar because it is a personnel issue.     Sexual assault charges were dismissed Friday against a Madera County sheriff's deputy who was suspected of raping his unconscious estranged wife and videotaping the attack.

    Prosecutor Marlea Dell'Anno dropped the charges against Jerry Saldivar in Fresno County Superior Court, saying there were "issues" with the alleged victim.

    Attorney Richard Beshwate, who represents Saldivar, said prosecutors were concerned about the estranged wife exhibiting erratic behavior during a messy divorce.

    Saldivar, 38, of Clovis had faced up to 18 years in prison if convicted of eight charges that included spousal rape, false imprisonment and rape of an unconscious person.

    "I've always said they were false allegations," Beshwate said.

    The charges stem from an incident that allegedly happened Feb. 28.

    In a court declaration, Saldivar's wife said she and her estranged husband went out for dinner and drinks and then returned home. She said the drinks made her sleepy. When she awoke the next day, she said she was wearing different clothing and felt pain that she believed was from a sexual assault, court records said.

    When Clovis police arrived after a 911 call, the woman told officers that Saldivar had allegedly raped her and had "videotaped the entire tragic episode," court records said.

    With the charges dropped, Saldivar, an 11-year veteran of the Madera County Sheriff's Department, wants to go back to work, Beshwate said.

    Sheriff's spokeswoman Erica Stuart said Saldivar remains on paid administrative leave. She said she could not comment further because it's a confidential personnel matter.

    Judge Denise Whitehead dismissed the charges without prejudice, meaning they can be refiled. Beshwate said that appears unlikely, because Saldivar's wife has caused at least two disturbances.

    Fresno police said Saldivar's estranged wife allegedly attacked him in April. In addition, police recently were called to quell another disturbance when the estranged wife showed up at the home of Saldivar's parents, Beshwate said.

    "My client wants her to get help," Beshwate said.
