[Excerpts] An Elkins police officer has been suspended from the force pending the outcome of an investigation into a criminal complaint alleging that he assaulted his wife. Willard Lewis, 28, is being held in the Tygart Valley Regional Jail on a felony charge of kidnapping, and misdemeanor charges of domestic battery and domestic assault... According to the complaint, the officers found the front door of the home partially open... Although the officers did not find anyone inside the home, they did discover the door trim leading into the bedroom damaged and lying on the floor... According to the complaint, because of evidence at the scene and the lack of knowledge of the whereabouts of Roxana Lewis, the officers told the Randolph County 911 Center to make a broadcast of an endangered and missing person. The officers were later alerted that Roxana Lewis was at the Adamson residence. The officers returned and obtained a handwritten statement in which she says Willard Lewis started belittling her and calling her names. "The victim advised she left the room to get away from the defendant," the complaint states. "The victim advised the defendant kicked the bedroom door, which caused damage to the door jam. The victim stated she started to hug the defendant and he pushed her away." According to the complaint, she told the officers she went into the bathroom to get away from Lewis and he said he was going to knock down the door. "The defendant grabbed her face and pushed her against the wall," the complaint states. "The victim advised she believed the defendant's elbow caught her eye." According to the complaint, Roxana Lewis told the officers that she said she wanted to leave and Willard Lewis would not allow her to leave. It further states that Roxana Lewis told the officers her husband told her they were going to go for a ride before the police arrived. She also said Willard Lewis did not threaten her, but made it clear "that something bad would happen" if she did not get in the vehicle, according to the complaint. Court records show that the Lewises were involved in another domestic situation in August 2009 in which Willard Lewis was injured when Roxana Lewis struck the side of his vehicle with her car. The incident happened near Rich Mountain... [Full article here]

ELKINS -- At a preliminary hearing Monday, an Elkins police officer had one of the charges against him dropped.
Willard Lewis, 29, of Beverly, was originally charged with kidnapping, domestic battery and domestic assault and a dispute with his wife on March 31.

Monday, prosecutors filed a motion to dismiss the felony charge of kidnapping. The victim did not feel that she was kidnapped, prosecutors said.

Lewis is still facing the two misdemeanor charges.

He may also face a third charge of intimidating a witness, according to prosecutors.

His next hearing is set for May 19. Lewis remains in the Tygart Valley Regional Jail, with bail set at $20,000.

A special prosecutor and a senior status magistrate were brought in for Monday's hearing after Randolph County authorities recused themselves.

Police Cadet Kelly Rothwell has been missing for a month and was scheduled to graduate from the police academy Wednesday. She's been missing since March 12th - the day she planned to break up with boyfriend David Perry, a former New York state prison guard.
