A probationary deputy sheriff accused of burglarizing his ex-girlfriend's apartment in March was able to obtain a key from an apartment manager because he co-signed the lease for her on the apartment, according to a search warrant filed in Kern County Superior Court. But Joshua David White, 25, is still charged with burglary and possession of stolen property because the victim, 24-year-old [S.G.], told him in November after he entered her apartment then that she didn't want him in the apartment and she took a key from him at that time... Deputies set up a tape-recorded telephone call between Gann and White on March 16. In the call, he admitted he was mad at Gann because she didn't tell him about her personal life and he admitted getting the key from the apartment manager... [Full article here]

The wife of Ft. Lauderdale Police Chief Frank Adderley is now home free after serving 181 days in jail. Eleanor Adderley was sentenced in October to nine months behind bars for shooting at her husband. Eleanor left the Broward County Jail just after 3:00 a.m. Thursday. Eleanor shot at her husband in their home in July 2008 over an affair he was having... At her sentencing last year, a remorseful Eleanor explained that she was the one her family and friends always leaned on and didn't know how to ask for help when she needed it most. Adderley's original charge of aggravated assault with a firearm carried a mandatory 20-year term of imprisonment. She pleaded no contest to aggravated assault without a firearm and a charge of using a gun in an occupied building, eliminating the mandatory 20-year sentence. Police say in she shot at her husband while he was lying in bed in their Plantation home. He was unharmed, but she continued shooting while she chased after him as he ran to a neighbor's house. That neighbor was also Adderley's best friend. It was then that she broke down, telling her neighbor that she was on the verge of killing herself. Psychologists who testified said it appeared she was suffering from severe depression and this violent outburst was a one time incident. The couple separated after the shooting incident; Frank Adderley filed for divorce. Their 16-year-old son lived with him while his mother was in jail. The two will now share custody. [LINK]

HALFMOON -- An Albany police officer was suspended early today following his arrest on charges related to a domestic incident involving his girlfriend.

Officer Robert Schunk was arrested by Saratoga County sheriff's deputies over the weekend and charged with criminal mischief, criminal trespass and harassment in connection with an incident at the southern Saratoga County residence of his girlfriend. Schunk, 38, was arraigned in Halfmoon Town Court and released. Details of his allegations against Schunk were not immediately available.

It's the second time in five years that Schunk has been arrested and suspended from duty. In April 2005 he was charged with drunken driving in Albany after he crashed his car into two parked cars on South Allen Street. Initially, Schunk fought the charges, claiming internal affairs officers did not properly read him his rights when he refused to take a blood alcohol test.

His driving privileges were restored by an administrative law judge after officers gave conflicting testimony at a motor vehicle hearing about the circumstances of Schunk's arrest.

Schunk later dropped the court challenge in his criminal case, pleaded guilty to a reduced charge of driving while ability impaired and returned to duty.

Schunk is assigned to the Strategic Deployment Unit, a tactical police unit that aggressively patrols high-crime areas in Albany.

Schunk's arrest on Saturday followed the arrest of his girlfriend, Barbara Waters, 36, of Clifton Park. She was arrested by Albany police on Saturday morning for criminal mischief after allegedly ransacking Schunk's residence in Albany. Police said she damaged a window, computer, picture frames and poured cooking oil throughout Schunk's residence.

It's unclear when Schunk is alleged to have gone to Walters' residence. He was arrested after turning himself into Saratoga County sheriff's deputies on a complaint filed by Walters.

Why does it take a 3rd violent crime to begin taking action to fire this officer or to consider discipling him? What is the purpose for reducing his charges, especially after the second arrest for family violence which violated his first diversion agreement? Why wasn't the first diversionary agreement's punitive consequences applied after the 2nd arrest? Is it sort-of okay at Columbus Police Department to hurt your family members and still don a badge, wield a weapon, and arrest members of the public for their crimes? It must be. Could Officer Elias assault Columbus City Administrator Evan Capron's wife a 1st and 2nd time without losing his job and being prosecuted?

DOMESTIC VIOLENCE IS NOT A PERSONAL OR PRIVATE MATTER.

Could Elias break into a local drug store in the evening and get caught twice stealing drugs - a NON-violent crime - and still go back to work as a cop? DOMESTIC VIOLENCE IS A CRIME. Tough talk now from the city administrator, but it's already clear that a little wife-beating is allowed by officers in Columbus Kansas.

[Excerpts] The city of Columbus suspends a police officer after he is arrested for domestic battery. But this is not the first time he has been arrested for violence. Columbus City Administrator Evan Capron says he asked the officer to voluntarily resign on Friday, but he didn't. Kevin Elias was then suspended and turned in his badge, gun and uniform... Kevin Elias was arrested March 25 after police say he and his wife had an altercation. Both were arrested for domestic battery. Elias has been charged with misdemeanor domestic battery twice before, after injuring his wife and another family member. Those were settled with a diversionary agreement... Domestic abuse expert Rebecca Reedy is the Executive Director of the Crisis Resource Center and she says the position of being an officer should not protect Elias. "I don't think occupation really makes a difference," Reedy says. "Domestic violence is really about power and control over another person and in those relationships the equality is no longer there." [Excerpts] Diversionary agreements signed in misdemeanor cases against a Columbus police officer allow him to avoid automatic revocation of his police certification... A misdemeanor charge of domestic battery was filed July 6, 2009, in Cherokee County District Court alleging that the officer, Kevin Elias, “intentionally or recklessly” injured his wife, Elena Elias, on Dec. 27, 2008. The incident allegedly took place in Baxter Springs, where Elias lives. Elias also had been charged in Baxter Springs city court with misdemeanor domestic battery in connection with an incident on May 2, 2009, involving a different family member. Attorney Robert Myers prosecuted both cases. Myers is the Baxter Springs city attorney, and he was appointed special prosecutor in the case in district court. Myers entered into diversionary agreements in both cases with Elias and his attorney, JoAnna Derfelt... The agreement was filed Jan. 28 in district court on an amended charge of misdemeanor battery. The agreement requires Elias to pay court costs of $152, a diversion fee of $50 and a fine of $100. He also must complete an alcohol abuse treatment course and an alternative to battering course offered by the Ozark Center in Joplin, Mo. Elias stipulates in the agreement that the allegations in the original complaint are true and that he would not contest them if he fails to follow the agreement. In the Baxter Springs city court case, a diversionary agreement was filed Feb. 12 on an amended charge of disorderly conduct. It requires a fine of $100, court costs of $100, a diversion fee of $150 and a fee of $25 for fingerprinting. Elias also is required to undergo an alcohol and drug safety action program, commonly called ADSAP... Columbus City Administrator Evan Capron said the city has taken no disciplinary action against Elias. He said he would consult with the city attorney about future actions. [LA] Officer Nacoste arrested on domestic abuse battery of wife charge

A Baton Rouge police officer was arrested Wednesday for allegedly hitting his wife during an incident in February. According to the Baton Rouge Police Department, Sgt. Otis Nacoste was booked into the East Baton Rouge Parish Prison on a domestic abuse battery charge. Investigators said Nacoste's wife called 911 around 11 p.m. on Feb. 28 to report he had hit her during a fight. He was not on duty at the time. His wife was treated at the hospital for an eye injury. He was initially placed on administrative leave, but on March 19 he was allowed to return to restricted desk duty. Officers said Nacoste will remain on desk duty pending the findings of an internal investigation. Reports showed he suffered a bite wound during the fight with his wife. He is a 23-year veteran patrolman of the police department. [LINK]

[Excerpts] A Bexar County jail guard who was attacked at work last week became the accused aggressor when he allegedly beat up his wife, authorities said. Bexar County investigators arrested Ray Quintero, 32, at his mother's house on Wednesday night. The Bexar County jailer, a deputy since 2004, is accused of punching and choking his wife following a domestic dispute Wednesday morning. He was released from Bexar County Jail early Thursday after posting $5,000 bail. “This is an unfortunate incident, and this officer does not reflect the other men and women that work for the Sheriff's Office,” said Linda Tomasini, an agency spokeswoman. “In no way does he represent the other fine officers that work for us.” Authorities began investigating the assault after Quintero's wife, also a deputy at the county jail, showed up at work on Wednesday with “visible signs of abuse,” Tomasini said... [Excerpts] New details are emerging about Memphis firefighter Frank Graham's relationship with his ex-fiance, Taffi Crawford. Graham is accused of shooting and killing Crawford outside Delta Medical Center. Frank Graham made his first court appearance Monday. A judge denied bond. Friends say 35-year old Taffi Crawford was fun, energetic and religious. Crawford's best friend, Regina Curtis says, "everytime you saw her she had something biblical to say to you"... Crawford's ex-fiancé and Memphis Firefighter, 34-year old Frank Graham III, is charged with her murder. Court documents show Graham shot Crawford 3 times... "I knew she was trying to get away from him, didn't want to have anything to do with him. He just wouldn't accept no"... Graham's ex-wife accused him of being abusive too. She said she "feared for her safety"... The papers say domestic assault charges were pending in Shelby County but there is no record of those charges now. And, as we reported Friday, Graham's ex-wife and former father-in-law tried to get restraining orders against Graham 3 times. All were dismissed or denied... "How can someone keep jumping and abusing women? Just because he's a firefighter, he gonna do that? I don't understand." Curtis says Crawford broke off an engagement with Graham... In turn, he allegedly broke her finger trying to get the ring off. She says, in the days before her death, Crawford stopped taking Graham's calls and he had accused her of dating another firefighter... [Excerpts] A Memphis nurse who was shot to death on a hospital parking lot in 2010 told her pastor two months earlier that her ex-boyfriend had threatened to kill her, a jury was told Wednesday. The ex-boyfriend, Frank Graham, made the threat to Taffi Crawford during a Sunday service at the New Fellowship Christian Church in Olive Branch where both were members, pastor Rev. Dwight Saulsberry recounted. "She told me Frank (Graham) had threatened her that day at church," said Saulsberry, who also is the chaplain for the Olive Branch Police Department. "She was pretty hysterical. She told me Frank told her he was going to 'blow her (expletive) head off.' She said she was terrified of him"... Graham, 36, a former Memphis firefighter, told police he was only trying to scare her... Crawford, 35, whose son by an earlier marriage was 7 at the time, died the next day... The couple had dated for several years and were engaged at one point, but Crawford told friends she had broken off the engagement in late 2009 and that she wanted to get away from Graham... A Criminal Court jury, however, found him guilty of first-degree murder in the 2010 death of nurse Taffi Crawford, who was killed in the parking lot of the Delta Medical Center as she arrived for work. The jury returned the verdict against Graham, 36, after deliberating for just an hour Monday. He was automatically sentenced to life in prison. "The family has been waiting almost two years for this," said state prosecutor Missy Branham, who was joined on the case by Jennifer Nichols. "They are very pleased with it"...
