Anderson Police Department Officer Lincoln Brooks is serving a suspension related to a provocation incident in April. APD Det. Mitch Carroll, public information officer, confirmed Friday that Brooks’ suspension had begun in accordance with the Anderson Board of Public Safety... On Sept. 19, Brooks, 43, pleaded guilty to misdemeanor counts of public intoxication, disorderly conduct and provocation and given a 180-day suspended jail sentence. Prosecutors charged Brooks on July 14 after he tried to goad an Anderson resident [his girlfriend's ex-husband who Brooks has a restraining order against] into a fight on April 7. The incident occurred outside the man’s Home Avenue residence. Brooks’ case was on the agenda for the Oct. 1 meeting of the Board of Public Safety, but no action was taken. Instead, Brooks’ attorney, Bryan Williams of Anderson, was working to reach an agreement with the board on disciplinary action.... [Full article here]

[Excerpts] An Anderson police officer has pleaded guilty to two misdemeanor charges, including disorderly conduct and public intoxication, and given a suspended sentence. Officer Lincoln Brooks, 43, Anderson, pleaded guilty Friday to public intoxication and disorderly conduct, both Class B misdemeanors, and provocation, a Class C infraction. During the same hearing, Judge Pro Tempore Geoffrey Yelton, filling in for Anderson City Court Judge Donald Phillippe, gave Brooks a 180-day suspended jail sentence for each misdemeanor. Yelton fined the officer $236 and ordered him to pay $164 in court costs. Brooks, a 10-year department veteran, declined comment Wednesday. He pleaded guilty without an agreement with prosecutors. He had been expected to stand trial Oct. 22. A Class B misdemeanor carries a maximum punishment of 180 days behind bars and a $1,000 fine... Prosecutors charged Brooks in July for trying to goad Mark A. Kumkoski into fighting him outside Kumkoski’s Home Avenue residence April 7... He admitted to drinking several beers before going to Kumkoski’s home and “admitted that he intended to fight Kumkoski,” according to the affidavit... Assistant Chief Keith Copeland said Brooks remains on desk duty. Copeland said department officials were reviewing the internal investigation... Brooks was given the police department’s Combat Cross Award in February for having faced an armed suspect. Brooks shot to death Cheyenne Miller, 27, in April 2007 after Miller pulled a knife that resembled a gun inside a darkened garage in the 400 block of West 34th Street... Full article here]

All that this incident proves is that those that are in a position of authority are given free reign of their power, and not held to any personal code of conduct themselves. Anyone else would have been arrested and charged with multiple offenses, i.e. violating a restraining order, intimidation, public intoxication, and tresspassing. What kid of message is being sent when the people who are supposed to enforce the laws are not expected to follow them themselves. This is hypocracy at it's best. Lincoln Brooks is a sad pathetic person on a power trip. The actions of the police force, protecting their own is sad, but typical. You wonder why one bad cop makes you all look bad? Because you associate yourself with his behavior by helping him break the law. Just because you were not personally involved means nothing. By helping to sweep in under the carpet, you are condoning, and as long as cops like Brooks are allowed to act this way, without consequence, it will continue to happen. I think that he should be fired, and I believe that the prosecutors of this town need to bring up criminal charges against him. Something needs to be done before another incident happens and it is too late.

There is no proof that the policeman was drunk since he refused to take the test, but he was driving. I live right across the street from the home of Kumkoski and was awkened by the beatting on his door I got up, looked out the window and watched as Brooks got back in his truck and drove off at a high rate of speed out of the neighborhood. I returened to my bed at this time thinking it that things would be quiet now however about five minutes later i heard the sound of the truck return and the screeching of tires. so I got up again and watched as he got out of his truck went inside my neighbors front porch and again started pounding on the door asking Mr Kumkoski to come outside. So the theory that his truck might have just been there is nonesense.. btw he parked in a no parking zone, there is no parking on my side of the street.

Imagine that, the one year anniv. of the death of a father! Now does the public see what kind of officer he is, was, whatever! The other guy is lucky Brooks didn't shoot him 4 times to death! You know you did wrong Brooks, face that and maybe you will see what hearts you have broken and what you took away (forever) from 4 small children, that never got an apology from YOU! Oh and why didn't the other officers shoot you for being drunk????

Why was the police officer not arrested. There was a restraining order in which he broke since he was going to Kumkowski's home to confront him and to fight him. He should of been arrested just for being on his property. Police officers should have to be held to the same laws as anybody else. This looks really bad when Brooks once again gets away with anything he does. Get him off of the force before something else happens. Arrest him. It is not too late and someone needs to follow up on this. If the police chief is not going to do anything about this, then someone needs to go over his head. This guy needs to be arrested for the law that he broke. He is no better than anybody else. Just because you have a badge, doesn't mean you can break the law with no consequences.

I live right across the road from where the incident took place. I was awoken at 5 am by the beating on my neighbors door and the loud yelling of the expletives. I know Mark Kumkoski and his ex for a long time. They seeemed like a perfect couple . I don't know any of the details of things which lead to this happening, but i know they have a very well behaved son, and it's a shame the child has to go through all this because the adults in his life don't get along.
I wasn't sure who was disturbing my sleep but it upset me a great deal, and they should have been aressted, makes no difference who they are nor what the circumstances are. Things like this get way out of hand when nothing is done about it and it will continue to escalate. what is sad here is that the child is going to be tied up in the whole mess. wether or not the reported policman is charged with anything or not all the parties inolved need mediation someone to talk to them as a group and smooth out their differences befor it goes any farther,, for the sake of the child!!
