[Excerpts] A former Russell County sheriff's deputy who had a murder charge against him dropped was arrested again on the charge Monday. Mike Britton, 57, turned himself in at the Lee County Detention Center at 11:40 a.m... A grand jury indicted Britton Wednesday on one count of murder. "It was re-presented," [Lee County Sheriff Jay] Jones said. "There was more information." Britton was first arrested Oct. 7 and accused of fatally shooting Bryan Hurst, 32, whose body was found with a gunshot wound to the chest... Britton, Hurst and Britton's daughter lived together at 899 Lee Road 292 in Smiths Station, Ala. Hurst and Britton's daughter have a child together. Britton spoke with deputies and was charged with murder. He later made bond and a grand jury dropped the charge. The case, along with more information, was presented to another grand jury last week, and Jones said this time the panel decided that the evidence supported an indictment. [Excerpts] ...911 received the call around 11:00 A.M. on Tuesday indicating that a shooting had taken place on Lee County Road 292 in Smiths Station. Arriving deputies were met by Britton. They later found 32-year-old Brian Hurst dead with a gunshot wound to the chest inside the home. Deputies had responded to a call at the same address around 9:00 P.M. the night before. "Mr. Britton in that particular instance was the caller and indicated that his daughter had been assaulted by Brian Hurst," Jay Jones, Lee County Sheriff said. I knew Mike many years ago. He was not a violent person. He was a really nice person. May God be with him. I hate this has happened to such a good man.
