[Excerpts] SEBRING - Motions to dismiss the charges against two day care workers charged in connection with the death of 22-month-old Kaedyn Short were withdrawn and their cases will next come before the court on May 6. Linda L. Payne, 39, of Sebring, and Sara J. Vasquez, 25, of Zolfo Springs, are both charged with failure to report child abuse, a first-degree misdemeanor. If convicted, they could face up to a year in jail and a $1,000 fine... Payne is the director of A Better Choice Children's Academy in Sebring, which Kaedyn Short attended. The indictment accuses her and Vasquez of failing to report suspected abuse between Dec. 1, 2007 and Oct. 31, 2008. Short died May 27, 2009 at a hospice home where she was being cared for in her final days. Former Avon Park police officer James Parker was reportedly watching the child while her mother and his former live-in girlfriend, Jennifer Short, was at work... Parker is charged with first-degree murder and aggravated child abuse. He is next due back in court for a pretrial conference on June 17. PAYNE FOUND NOT GUILTY

[Excerpts] Linda Louise Payne, 41, was acquitted by a jury on Friday after facing charges that she did not report suspected abuse upon 22-month-old Kaedyn Short... Payne, according to Highlands prosecutor Courtney Lenhart, failed to produce an incident report on Kaedyn after an investigation into her death began. Teachers at the day care reported bruises on the infant in 2008. Payne's defense attorney pointed out that Payne was not at the day care the day the incident report was filed and that two teachers at the day care who noticed the bruises never contacted the Department of Children and Family Services. The assistant director, Sara Vasquez, took the report and called the mother, who claimed that the bruises were caused from the child playing in moving boxes at a babysitter's house. Vasquez was also charged with failure to report abuse, but received deferred prosecution. The jurors took just over two hours of deliberation to render the not guilty verdict. [Full article here]

    How about an update on this case. Linda Payne was found NOT Guilty in jury trial. In fact,there was absolutely NO evidence whatsoever in this case. A former teacher(who was not rehired by Mrs. Payne, and therefore was disgruntled) created these allegations, and the Sheriff's Office (where Mrs. Payne's husband is an officer) couldn't wait to go after "one of their own." At trial, all of the teachers involved, including the one who created the allegtions, stated that at no time during the child's enrollment, did they feel that the child had been abused. The news media neglected to inform readers that neither Mrs. Payne, nor Ms. Vasquez had seen the child during the 6 months prior to her injuries that caused her death. The child even attended another day care after leaving Ms. Payne's, and that day care wasn't even investigated. The person who created the allegations against Ms. Payne and Ms. Vasquez received immunity from the State Attorney's office, and was therefore never charged. She ultimately should have been the one charged if she suspected abuse and did not report. It was clearly a witch hunt against the Payne family, confirmed by her Not Guilty verdict.
