[AL] Officer shoots, wounds her adult son - "documented history of domestic violence in the home"

July 30, 2011
DOTHAN POLICE CHIEF GREG BENTON:
“The investigation into this shooting is in the earliest stage, (but) a preliminary investigation has revealed there was a documented history of domestic violence in the home between the officer and the officer’s adult son. Investigators have learned the involved parties have had limited contact following a documented domestic situation which occurred earlier this month. The shooting (that) occurred today appears to involve self-defense on behalf of the officer involved.”

[SC] Maryann Powell Cox was murdered 4 days after reporting SLED Agent Charles Boyette's domestic assaults

Moncks Corner, SC - On July 18th South Carolina Law Enforcement Division [SLED] Agent Charles Boyette was reported to the Berkeley County Sheriff's Office [BCSO] for recent armed physical and sexual assaults by his ex-girlfriend, Maryann Powell Cox.

..."He said we both were going to die today... I kept telling him no, he did not want to do that. He kept saying yes he did and that there was 'no going back'"...

According to BCSO Maryann told them that she didn't want Boyette prosecuted - just kept away from her. BCSO made it clear they have to report this to SLED. SLED was notified and quickly suspended Agent Boyette without pay - indefinitely, had him turn in his SLED equipment, and initiated an investigation. Boyette was not detained to assess his level of danger to himself or others, and there is no mention of his personal weapons being removed from him. Agent Boyette resigned July 20th - which is changing now to he "retired for medical reasons."

July 22nd, Boyette brought Maryann flowers to her job, at Southcoast Community Bank, and then came back and murdered her and himself when she left the bank at the end of her workday.

...Authorities say a former SLED intelligence supervisor shot and killed a woman he had a relationship with and then took his own life outside a bank in Moncks Corner Friday afternoon. Berkeley County Coroner Bill Salisbury says Charles H. Boyette and 44-year-old Mary Ann Cox, both of Moncks Corner, both died of gunshot wounds in the murder-suicide... Witnesses say Boyette visited Cox at Southcoast Bank twice on Friday where she worked as a teller. He brought her flowers the first time and wielded a gun the next, shooting Cox, then killing himself in the bank's parking lot...

Facebook Group: R.I.P MaryAnn Powell Cox

...Maryann Powell Cox was one of the sweetest, most loving, beautiful, and funniest women I have ever known. She made everyone feel better just being around her... Her life should not have ended this way, PERIOD. We will miss you and your smile Maryann...

...This woman helped me when I had no where else to go. She took care of my son when I worked three jobs to make ends meet. She took care of her boys and her husband when anyone of them got sick. She worked two and three jobs so she could pay bills when her husband was out of work. Mary Ann did so much good by so many people...

...This is very sad. A women lost her lfe to a man that could not handle his situation. It is not stress related. I have been a cop for many years and have been in many stressful situations. You learn to handle it... This states law enforcement idea of just letting a person go from one place to another without any type of psychological evaluation or assisitance is a REAL PROBLEM...

Excerpt from obituary: "...Boyette was a former SC State Trooper, an ABC agent, a detective for Charleston County, and a FBI Homeland Security Task Force Agent..."

Prayers go out to both families from many.

[Excerpts] Authorities say a former SLED intelligence supervisor shot and killed a woman he had a relationship with and then took his own life outside a bank in Moncks Corner Friday afternoon. Berkeley County Coroner Bill Salisbury says Charles H. Boyette and 44-year-old Mary Ann Cox, both of Moncks Corner, both died of gunshot wounds in the murder-suicide. According to investigators, around 5:30 p.m. on Friday, Boyette approached Cox, shot her and then shot himself outside the South Coast Community bank on East Main Street. On Monday, the sheriff's office received a complaint by Cox regarding allegations of an assault/incident involving Boyette. Cox told deputies that she had a relationship with Boyette for over a year and ended it on July 4. She said that Boyette was extremely unhappy about the breakup. Authorities then notified SLED Chief Mark Keel regarding the incident. After reviewing the complaint, Keel suspended Boyette on Tuesday and requested the sheriff's office to investigate the allegations because of the serious nature and to avoid a conflict of interest. The following day Keel says he received a letter of resignation from Boyette. Boyette was hired at SLED on Jan. 4, 2000... "I can't remember a case like this. It is a rare case," said Lt. By Diette Courrégé, Andy Paras
Sunday, July 24, 2011
[Excerpts] On Monday, Mary Ann Cox asked local deputies to keep a SLED agent, a man she said was her former lover, from contacting her any more... They said Charles Boyette, 61, shot bank teller Mary Ann Cox, 45, three times -- twice in the arm and wrist and once in the back - as she was leaving Southcoast Community Bank on East Main Street about 5:30 p.m. He then turned the gun on himself and fired into his chest. The pair were within feet of each other and were dead when police arrived... Cox had sought help from authorities before the shooting. She told Berkeley County sheriff's investigators on Monday that she had been in a romantic relationship with Boyette for more than a year, but she ended it July 4 and he had been "extremely unhappy" ... Boyette and Cox were married but not to each other... Cox told officials that she didn't want an investigation into an alleged assault to go any further, but asked that Boyette not contact her any more. Deputies met with Boyette and told him to stay away from Cox. They forwarded her complaint to SLED Chief Mark Keel. Keel asked the sheriff's office to investigate the allegations because of their severity and because he wanted to avoid the appearance of a conflict of interest... Keel suspended Boyette without pay on Tuesday, pending the outcome of the investigation. Boyette resigned on Wednesday, and his attorney, Lionel Lofton... Lofton met with Boyette on Tuesday and with Boyette and his wife on Wednesday to discuss his suspension from SLED, and they agreed it was in Boyette's best interest to retire so he could take care of some health issues, Lofton said. Boyette had been having seizures and didn't know why, Lofton said. Boyette already had retired from the state but was continuing to work because he had been doing it all his life, loved it and wanted to make a contribution, Lofton said... [Full article here]

According to police reports, Boyette had resigned from the State Law Enforcement Division (SLED) on Wednesday, July 20, over a complaint filed against him by Cox on July 18. “Mr. Boyette approached Ms. Cox in an area behind the Southcoast Bank building as she was leaving work,” [Moncks Corner Police Lt. [Excerpts] Charles Boyette was laid to rest Monday in Moncks Corner where visitors paid their respects for the man police say he took his own life after killing Maryann Cox... But there may have been signs of trouble. A police report filed about a week before the slaying shows Cox and the former SLED agent, Boyette were having a romantic relationship, one that was becoming shaky. The report says Cox ended the relationship after an "incident" took place and that she didn't want him to contact her anymore. Berkeley County Sheriff's Office spokesman Dan Moon says they cannot say what she accused him of or release the statement included in the incident report filed on July 16th. Moon says the information is restricted because the incident is still under investigation... In a press release on Monday, Moncks Corner Police authorities say Cox later refused to cooperate with their investigation. The day after SLED Chief Keel suspended Boyette, he turned in his letter of resignation. Two days after that, Cox and Boyette were dead with many questions left unanswered. "That's the sad part. That cowardly, he's taken himself out," Green said. The investigation into the murder/suicide is closed, according to the Moncks Corner Police Department. Berkeley County Sheriff's authorities say their investigation into the original incident is still underway... "When she was walking outside she was carrying the flowers. From what it looked like, he was walking up to her and he did what he did and the flowers were laying in between the bodies after it was done," Kevin Timmons said. Timmons, who works next to the bank at Baron's Department store saw it all unfold and says Boyette had shown up to the bank earlier to give Cox flowers. He says Boyette came back when she was leaving the bank, where she worked as a teller, before taking both their lives. [Full article here]

SHOOTER WAS SLED AGENT SUSPENDED FOR HARASSING VICTIM
Berkeley Independent
By Dan Brown
Published Tuesday, July 26, 2011
[Excerpts] The man who shot and killed Southcoast Bank employee Mary Ann Cox was a former SLED agent who lost his job last week because of a complaint filed against him by the victim. In a release from Kathryn Richardson, spokesperson with the State Law Enforcement Division, agent Charles Boyette, 61, of Moncks Corner was immediately suspended following the filing of a complaint against him by Cox... The report went on to say that Boyette was “very unhappy with the breakup,” and Cox provided a detailed voluntary statement to police concerning Boyette’s actions, which included photographed text messages sent by Boyette to Cox’s cellphone. Cox also advised the BCSO that she did not want the investigation to proceed any further, only that she did not want Boyette to contact her anymore. Boyette, 61, was a supervisor in SLED’s intelligence division working out of its Charleston office. After Cox filed the complaint, the BCSO met with Boyette and placed him on notice not to engage in any further contact the victim. On July 19, the BCSO contacted SLED, Boyette’s employer, and advised them of the complaint filed by Cox. Additional documents included in the SLED release show that on July 19, SLED Chief Mark Keel asked BCSO Sheriff Wayne DeWitt to investigate the harassment incident involving Boyette, “since the allegations are serious in nature and to avoid the appearance of a conflict of interest.” A second letter from Keel written on July 19 and hand delivered to Boyette announced his indefinite suspension without pay. Boyette then resigned from SLED on Wednesday, July 20... Two days later, according to MCPD Lt. Michael Roach, Boyette approached Cox as she left the Moncks Corner Southcoast Bank branch around 5:30 p.m. and fired three shots, two of them striking Cox in the shoulder and the back... [Excerpts] Maryann Cox was remembered at a funeral service Tuesday, after an ex-lover and SLED Agent shot and killed her Friday outside of Southcoast bank. Maryann was still married, but separated from her husband, Alan Cox, who gave her eulogy. He said their two sons, meant the world to her. "I know her thoughts that last minute. She was thinking of her children, and what she can do to save them," Alan said... "I didn't know about the affair until a month ago. I found out and confronted her," he said. "She was devastated, but she was trying to break it off with the gentlemen." Alan said his wife was not only involved with Boyette, but an additional man. He said this made Boyette jealous and his wife feared for her safety. "He didn't care if she went back to me, but didn't want her to go to anyone else, he said he would kill her if she did," Alan said. Alan said he knew Boyette and his family well, and has empathy for them. "His family is as much the victim as we are," he said. Alan said the separation would have ended in October, which would have marked one year. He said the two of them were going to discuss their relationship at that point. Now he will never get the chance. On his left finger was his wedding band. He also was wearing her ring. "It's my turn to wear it again and I will do so until I die." [Full article here]

MARY ANN COX REPORTED FRIGHTFUL INCIDENT WITH FORMER SLED AGENT DAYS BEFORE SHOOTING: BOYETTE ALLEGEDLY VOWED 'ROMEO AND JULIET' ENDING
The Post and Courier - Charleston, SC
By Allyson Bird, Andy Paras, Glenn Smith
Friday, July 29, 2011
[Excerpts] Just days before former SLED agent Charlie Boyette killed his former lover and himself, the terrified woman told investigators he had held her hostage at gunpoint for hours and sexually assaulted her... Mary Ann Cox told officers that Boyette came to her apartment armed and uninvited on July 16, demanding that they get drunk together. He raged. He cried. He begged. He jammed a pistol into her belly and later aimed the gun at his chest and pulled the trigger... In a written statement to Berkeley County sheriff's deputies, Cox said she pleaded with Boyette to let her go. He refused, she said, telling her, "This is going to be a (expletive) Romeo and Juliet." ... "He said we both were going to die today... I kept telling him no, he did not want to do that. He kept saying yes he did and that there was 'no going back'"... She told her story to Berkeley County sheriff's deputies two days later, but insisted that she didn't want to go forward with charges of kidnapping and criminal sexual conduct against Boyette. "I just want him to stay away from me," she wrote in a statement. "I do not want to see him ever again"... "I was absolutely shocked," SLED Chief Mark Keel said this week. "I could not believe it. Trust me"... On the morning of July 14, Cox said, she went to take her puppy for a walk and found Boyette lying on the porch of her Pinopolis Road home. He went inside, refused to leave and demanded that she spend the day with him... Cox told deputies that Boyette kept saying, "This is going to be a Romeo and Juliet." She also noticed that he was carrying a pistol, which he had not done during the entire span of their affair. "At that point I thought he meant he was going to shoot me and then shoot himself, so I asked him and he said yes he was," she stated... Boyette begged her to dump her new boyfriend and get back with him. She said no. Cox noticed that Boyette was carrying his pistol again and had parked his sport utility vehicle behind her car, blocking her in. When she told him she needed to leave, Boyette pulled out his pistol and started yelling that he was going to shoot himself and that she would likely be charged with his murder. Then he started crying and saying there was no going back. Boyette's friend Mark called and tried to talk him out of doing anything rash. That seemed to calm him down for a spell, but then Boyette went after Cox and assaulted her. He repeatedly threatened her with the gun and tried to shoot himself in the chest. He reportedly assaulted her again, then left as if nothing had happened. Cox bolted to a friend's house and called her landlord to say she was moving out... Cox told sheriff's deputies her story on July 18, but insisted she did not want an investigation into the incidents or to see Boyette lose his job one year shy of retirement. She considered the episode a personal matter and just wanted Boyette to leave her alone, according to an incident report. Chief Deputy Butch Henery told Boyette to stay away from Cox. Deputies also alerted SLED, and officials there asked Berkeley County to investigate the allegations. Keel also suspended Boyette without pay pending the results of that probe... Friends and family claim Savio told them during her divorce proceedings that if she turned up dead, her husband would be to blame... Friends of Stacy Peterson said that she made similar statements to them... Prosecutors have presented no physical evidence or eyewitnesses and have said the hearsay statements were vital...

Though you can't tell from the thousands of articles put out on Drew Peterson, this case has always been about officer-involved domestic violence. The articles don't explore what other victims married to a cop may be trapped into situations like Kathleen and Stacy were, unable to make police reports, fearing death any day - with no way to keep their children from their killer. None of the articles about Drew Peterson explore what is being done about domestically abusive cops or what policies some law enforcement agencies around the country are putting in place to make sure domestic violence in officer's homes is handled professionally. WHAT A SHAME on journalism, Illinois, the Chicago area, and really all of the U.S. - since there's no public outrage - that this horrid case isn't used to save lives and push for accountability. Instead it's served to us as entertainment, over the blood of Kathleen "Kitty" Savio and Stacy Peterson. It is discussed below that there is no physical evidence. GEE, I wonder why. How many wives and girlfriends on this blog, dead and alive, have said that they were told they would be murdered and that no one would be held accountable? Too many. Now Drew is looking forward to the very real possibility he may not have to go to trial - the day the children from his last two no-longer-living-wives will be returned to his care.

DREW PETERSON PROSECUTORS FILED HEARSAY APPEAL TOO LATE, APPELLATE COURT RULES

[Excerpts] Jurors deciding the fate of former Bolingbrook, Ill., police officer Drew Peterson won’t be allowed to consider a variety of hearsay evidence because prosecutors failed to appeal a trial court ruling within a 30-day window, an appeals court says. The Illinois Appellate Court’s 3rd District ruled Tuesday that prosecutors missed a deadline in one of three interlocutory appeals challenging evidence rulings. Peterson was accused of killing his third wife, Kathleen Savio, after his fourth wife, Stacy Peterson, disappeared. The Chicago Tribune covered the decision (PDF), which split 2-1 on the missed deadline. The trial judge had excluded eight hearsay statements on May 18, 2010, and the state did not file a motion for reconsideration or an appeal within 30 days... The trial judge had ruled six other hearsay statements were admissibl... The appeals court also upheld the trial judge’s exclusion of “other-crimes evidence,” including testimony about past incidents of domestic abuse and threats by Peterson against Savio and his second wife... EXPERTS SAY THE CASE MAY NEVER MAKE IT TO TRIAL

[Excerpts] The high-profile murder case against former suburban Chicago police officer Drew Peterson, accused of killing his third wife, may never make it to trial, experts say, after a court agreed prosecutors shouldn't be allowed to use certain hearsay statements as evidence. The ruling by a state appellate court this week upholding a lower court's decision to exclude eight of 14 hearsay — or second-hand — statements raises fresh questions about the viability of trying Peterson on charges he killed Kathleen Savio in 2004. Peterson was charged only after his fourth wife, Stacy Peterson, disappeared in 2007 and Savio's body was exhumed... Asked Wednesday how his client reacted to the ruling, lawyer Joseph Lopez said, "He's happy." Any hopes Peterson may harbor of altogether averting a trial in Savio's death may be well founded, some observers say... A person familiar with the case previously told The Associated Press that the statements excluded by the lower court judge included one from [4th wife] Stacy Peterson's pastor [Neil Schori], who said she told him she'd given Peterson a false alibi the weekend of Savio's death... Stacy Peterson is presumed dead by authorities. Drew Peterson has never been charged in her disappearance, but authorities have said he is a suspect... [Full article here]

APPEALS COURT UPHOLDS LIMITS ON DREW PETERSON HEARSAY EVIDENCE
Chicago Tribune
By Steve Schmadeke and Stacy St. Clair
July 26, 2011
[Excerpts] ...“It’s a big win because it keeps out evidence that was unreliable,” said attorney Steve Greenberg, who argued the defense team’s position before the appellate court. “It reduces the chance of the trial being based on rumor and innuendo.” Will County prosecutors have not yet commented on the ruling. The case, which has drawn national media attention, has been put on hold for more than a year as State’s Attorney James Glasgow pushed for the hearsay statements to be declared admissible. The trial judge had ruled jurors could not hear the statements because they were unreliable. Peterson, 57, is charged with killing Savio, who was found dead in a dry bathtub in 2004. Officials initially said the death was an accidental drowning, but authorities reopened the case after his fourth wife, Stacy Peterson, vanished in October 2007... Prosecutors can still appeal the case to the Illinois Supreme Court, but Peterson’s defense team believes the appellate ruling will be difficult to overturn. “It’s clear that the state is a day late and a dollar short,” defense attorney Joseph Lopez said. “It’s a good day for Drew. It’s a good day for all of us”... [Full article here]

PROSECUTORS CONSIDER APPEAL OF HEARSAY RULING IN DREW PETERSON MURDER TRIAL
FoxNews.com
Published July 27, 2011
Prosecutors say they are considering filing an appeal with the Illinois Supreme Court after a state appellate court refused to overturn a decision barring prosecutors from using some hearsay - or second hand - evidence against Drew Peterson, a former police sergeant accused of killing his third wife and a suspect in his fourth wife's disappearance... Peterson is charged with first-degree murder in the death of his third wife Kathleen Savio, whose body was found in a dry bathtub in 2004. Investigators initially ruled Savio's death an accidental drowning, but later reopened the case after Peterson's fourth wife, 23-year-old Stacy Peterson, disappeared in 2007. Peterson remains a suspect in the disappearance of Stacy, a mother of four who is still missing and presumed dead by authorities... "It's a resounding victory - without question"... The state appellate court's ruling on Tuesday means that prosecutors will not be allowed to admit 8 of the 14 hearsay statements they wanted to use in their case against him. Friends and family claim Savio told them during her divorce proceedings that if she turned up dead, her husband would be to blame, MyFoxChicago.com reports. Friends of Stacy Peterson said that she made similar statements to them... The Will County State's Attorney's Office said Wednesday that it strongly disagrees with the ruling and is mulling a decision to appeal... The ruling was particularly frustrating to the members of Savio's family, who have been trying to convince authorities since shortly after Savio's death that she did not simply drown accidentally. "I was very shocked," Savio's sister, Susan Doman, told MyFoxChicago.com after the ruling. "My heart was set on being able to get everything in with the hearsay evidence. I believe that the jury should hear everything," Doman said... [Full article here]

[NC] TEFLON: Assaulting handicapped wife charge couldn't stick to Officer Wiley

There is nothing in any article written that speaks up for the wheelchair-bound estranged wife of Shelby Police Officer Marshall Letitus Wiley. There is only what a good guy Officer Wiley is, how he wouldn't do a thing like assault his wife, how he comes from a law enforcement family, who supports him, on and on. His wife's voice and accusations are as nothing, completely unrepresented in the news. Why he was found not guilty isn't even hinted at - as if that's not important.

[Excerpts] A city police officer was found not guilty of assaulting his estranged wife Tuesday, but he can’t return to duty until an internal investigation is complete. Gaston County District Court Judge John Greenlee acquitted 29-year-old Marshall Letitus Wiley in a Tuesday morning hearing, according to court records. He had been charged with assault on a handicapped person stemming from an alleged May 24 tussle with his wife at her Gaston County home... Wiley, who joined the Shelby Police Department in December 2008, was placed on paid administrative leave pending the outcome of the criminal and internal cases... Wiley graduated from Shelby High in 2000 and played on a Golden Lions state championship football team, Eskridge said. After working at an auto parts store, Wiley became a corrections officer at the Cleveland County Detention Center, his sister said. After working 12-hour shifts at the jail, he drove to Gaston College in Dallas to take basic law enforcement training classes. Wiley’s grandfather was a Cleveland County sheriff’s deputy... [Excerpts] ...[Shelby police officer Wiley’s Shelby's] sister, Sherika Eskridge, said she doesn't believe the allegations. “This definitely not his character,” Eskridge said. She said her brother dreamed of being an officer. “He came from a law enforcement family,” she said. “Our grandfather was a deputy.” Eskridge said Wiley's proudest moment was when he started working at the Shelby Police Department in December 2008... “It was hard to be arrested in front of co-workers,” Eskridge said. Wiley's estranged wife filed the warrant in Gaston County, where she lives. She claims Wiley physically assaulted her at her home. She's in a wheelchair because part of her leg was amputated after an accident. Channel 9 talked to Police Chief Jeff Ledford about the allegations. “Law enforcement is held to a higher standard, but I think we should be,” Ledford said. He said his staff has started an internal investigation that will be as intense as any criminal investigation. “We have got to restore that public confidence and assure folks we do stuff above board,” Ledford said... [Excerpts] Marshall Wiley is a former high school football star and a cop’s grandson who cut his teeth in criminal justice as a Cleveland County jailer. The police officer who is accused of assaulting a handicapped woman last week isn’t the kind of person who would break the law, his sister said Wednesday. He has too much to lose. “He loves his job, and he definitely wouldn’t do anything to jeopardize his job,” said Shelby resident Sherika Eskridge. “He cannot keep his mind off it because it is his career and his reputation on the line.” Wiley, 29, was arrested Tuesday and charged with assault on a handicapped person. The incident allegedly happened last Thursday in Gaston County, but the details remain unclear. His arrest warrant had not been returned to the Gaston County Clerk of Superior Court’s office Wednesday. Family members are standing behind Wiley, who joined the Shelby Police Department in December 2008. Police Chief Jeff Ledford placed Wiley on paid administrative leave pending the outcome of his criminal case and an internal affairs investigation into the charge. “These allegations against him are definitely not his character,” Eskridge said. “They are out of character for him. They are just that — allegations. We are supporting him 100 percent. He is a good man”... Eskridge said media reports about the arrest and criticism from some in the community have taken a toll on her brother. “He’s upset, he’s hurt,” she said. “It’s not only tough on him, it’s been tough on his family as well.” [Full article here]

SHERIFF'S DEPUTY SUSPENDED AFTER CHILD ENDANGERMENT CHARGE: Veteran employee was acquitted of indecency in 2006 hot-tub case
Chicago Tribune
By Andy Grimm
July 14, 2011
[Excerpts] A Cook County sheriff's deputy with a history of off-duty incidents allegedly involving alcohol was suspended with pay Wednesday after being charged last week with misdemeanor child endangerment, authorities said. Sgt. Kelly Mrozek was charged after her 3-year-old son was found wandering her Orland Park neighborhood June 11 wearing only underpants and flip-flops... Police found Mrozek in her home, apparently intoxicated and disoriented... A few hours after the boy was placed in the custody of his godparents, witnesses reported Mrozek pulled into the parking lot of a restaurant near her home in her marked squad car. She was behaving erratically and sat down inside "our (unlocked) car," a witness told a police dispatcher. Mrozek was taken to Silver Cross Hospital; sheriff's officers arrived and took her squad car... The veteran deputy was charged in 2006 with public indecency... When police arrived at her home around 10 a.m. June 11, Mrozek was nearly incoherent, a police report stated. Her son told police that he walked out the open garage door, and that his mother had been throwing up, then fell asleep on the couch, the report stated... On Dec. 10, a witness told police that Mrozek tried to enter a bar wearing pajamas and carrying her son. Police found her buckling the boy into the back seat of her car when they arrived, and they allowed her to call her father for a ride home, the report said. On Dec. 27, Mrozek called police to report her son was missing, then called back to say the boy was at day care, authorities said. When police arrived at her house, they noted she smelled of alcohol and was belligerent, the report said. Mrozek was not charged after either December incident. Sheriff's department spokesman Steve Patterson said Mrozek had been on medical leave until Wednesday and was placed on paid suspension. The department has called for a merit board hearing on her employment status, Patterson said. [Full article here]

July 15, 2011
[Excerpts] A Cook County sheriff’s police officer from Orland Park has been suspended after another apparently alcohol-related incident involving police. Sgt. Kelly Mrozek, a sheriff’s officer since May 1994, faces a misdemeanor charge of endangering the life of a child after her 3-year-old son... Mrozek, 43, of 11037 Karen Drive, turned herself in to Orland Park police July 7 after going through an alcohol rehab program. Mrozek was suspended Wednesday, according to sheriff’s department spokesman Steve Patterson. He said she had been on medical leave since calling in sick June 11, which was a day she was scheduled to work... In the June 11 incident, Mrozek’s son told a neighbor he had left his house through the garage door about 10 a.m. because his mother was vomiting and had fallen asleep on the couch, according to Orland Park police. The neighbor called police, who went to Mrozek’s home and found her disoriented and an open bottle of vodka on the kitchen counter... The boy was released to family friends after the June 11 incident, and Orland Park police reported the case to the Illinois Department of Children and Family Services. Mrozek was released on bond and is scheduled to appear in court Aug. 10. Later on June 11, after Mrozek’s son had been taken away, sheriff’s police were called to 159th Street and Wolf Road to retrieve Mrozek’s squad car after she had driven to a nearby restaurant and got into a parked, unlocked car, Orland Park police said. The owner of the car didn’t recognize her and called police... [Cook County Sheriff's department spokesman Steve Patterson] said the merit board in May 2009 demoted Mrozek from lieutenant to sergeant and required her to complete a substance abuse program. Prior to her medical leave and suspension, Mrozek had been working as a sheriff’s patrol officer in the south suburbs... Patterson said that until sheriff’s police were contacted by Orland Park police last month, there was no indication of Mrozek being unable to perform her job. [Full article here]

Saying a Cook County sheriff's lieutenant and her boyfriend did not knowingly make a display of their sexual frolic in a back-yard hot tub, Will County Judge Marilee Viola on Thursday found both not guilty of public indecency... Mrozek, 38, took the stand Thursday and contradicted the 14-year- old boy, his mother and another adult neighbor, who all testified a day earlier... While on the stand, Mrozek also said she was not drunk that day. A day earlier, a Lockport officer said he believed she was intoxicated. She was slurring her words and misapplied lipstick on her face, he said.... Mrozek and Sumner were charged in February, after an assistant to Chicago Tribune columnist John Kass started asking questions about the situation.

[Excerpts] ...[Will County Judge Marilee] Viola ruled that yes, there was sex in the tub, or something very much like sex, and that yes, the tubbers in the back yard on Treeline Drive in Lockport were probably drunk, and yes, the neighbor's kid and other neighbors saw everything. But they weren't meant to. Viola came up with a fascinating legal interpretation, and here's her theory: If you have sex in a place where people can see you, but you don't think they can see you, even if you worked in the vice division of the Cook County sheriff's police and you understand the law, it's not public indecency if it's your back yard and there might be some leaves on a tree nearby. So not guilty!... Parents might want to consider the advantages of having neighbors furiously engaged outside, just about the time the kids come home from school. The kids won't bother you for milk and cookies. They'll be busy watching. And at dinner, the kids won't bore Grandma to death with obscure references from their computer war games... They'll be intrigued by gymnastics, contortions and how long someone can hold their breath underwater... [Lt. Kelly Mrozek] said she graduated with honors from Lake Forest College and the police academy, but she made no mention of the fact her in-law is the director of operations for the Cook County sheriff... Mrozek said "Absolutely not" to almost everything, contradicting police testimony that she was intoxicated and the neighbors who said she wasn't bobbing for apples. Quincy District Court Judge Paul McCallum ordered Dunn released on personal recognizance. Dunn will remain behind bars at the county jail in Dedham until he can be fitted with a device to monitor his whereabouts... Prosecutor Khushbu Mehta argued during a dangerousness hearing that Dunn should remain in jail because he poses a threat to the alleged victim and has access to guns. The trooper’s attorney, Courtney Linnehan, said police arrested the wrong person... The alleged victim, a 28-year-old Transit Police officer, refused to testify at the hearing on the grounds that what she might say could be self-incriminating. Following the incident at Dunn’s home Monday, the woman declined further medical treatment or to seek a restraining order against Dunn... Dunn’s father, retired State Police Lt. Col. Robert Dunn, also of Quincy, testified he has never known his son to be abusive... [Quincy police Sgt. James McNeil] said when he knocked, Dunn came to the door with blood on his face and shirt. There was broken glass and ammunition on the floor, and Dunn said he and his girlfriend had argued, McNeil said. McNeil said he heard someone crying on the second floor and found Dunn’s girlfriend. He said she told him Dunn had thrown a cell phone at her, grabbed her by the neck and pointed a gun at her, which she was able to knock out of his hand during the struggle. SUNLAND PARK OFFICER INDICTED IN ATTACK ON GIRLFRIEND
Las Cruces Sun-News
07/22/2011
[Excerpts] A Doña Ana County grand jury has indicted a former Sunland Park police officer on charges of raping, beating and threatening to kill his girlfriend. Patrol Officer Juan Saucedo, 21, was fired following his arrest - because he wouldn't answer questions about his whereabouts the night of the alleged attack - and could now file a lawsuit alleging wrongful termination, defense attorney Mario Esparza said.
